Default Processing Time

With all the forward movement in VISA bulletin which great news for everyone, there has been a slow down in processing times at TSC for I 485 processing. Now the processing times are not being updated as well. How do one go about finding the status update?

Well... no surprise about that, right? They now have more than what they can handle so processing will be slower. They might be concentrating on getting through with the FP requests, EAD/AP etc first before looking into final stage approvable cases. Its probably the same with Nebraska also? There have been comments on this thread that this is comparable to the July 07 fiasco to some extend. Teddy mentioned that even with 3012 they will not be able to clear 08 this year?

Default EAD renewal Fee

So many people are confused if they have to pay any money to renew EAD.
Bottom line is, when applying your I 485, if you paid $1050 as fees just for I 485 (excluding AP and EAD fees) you will get free unlimited EAD renewals.

If you did pay only $325 fees for filing I 485, you need to pay the New EAD fees ($385) everytime you renew EAD.

It is true that the new fee structure came into effect Aug 01 2007.
But some filers who filed in the month of Aug 2007 were asked to pay the Old fees amount.

I know this might not be the proper thread to post it but i need help...so may be some one of you might have answer for my problem
So back in 98 I was framed to be involved in college mob fight. I wasnt even present on sight. However charges were filed. NO arrest was made as antispatory bail was issued . Latter on it was proved in court that charged were framing and false so case was dismissed. Now when i tried to get police clearence from india it says FIR was made latter on case was dismissed
When I filled my ds-260 form i wasnt even aware of this situation. so clicked no . Now when I would present this police clearence with court order would it have any affect on my case
any help would be greatly appreciated ! May God bless you

Is it possible to file a new GC for someone who is on dependent EAD and currently utilizing the EAD? A friend of mine is on EAD and EB3 and in endless wait. Is it possible for his wife (on EAD through him) to file an independent GC?

there is no independent GC. If it existed, we all would have filed for it.LOL

GC can be Employment based, family based, asylum/refugee, religious or investor based. Lookup and see what category the friends wife falls in. If they have a million bucks, look for EB5.

I think you misunderstood what OP asked. What he meant is that the wife is employed via EAD and can she start her separate GC process as a principal applicant and can he be the dependent.

I think it is possible to apply PERM and I-140 for the wife. But at I-485 stage I think you need to flip the principal to dependent and vice versa as it is not good to have two I-485s pending for the same person. It depends on whose PD becomes current first.

This is my opinion though.

yes you are correct..

the question really is that could she (doctor by profession) file her own GC (through her employer as principal) while working on EAD through my friend. And later ad dmy friend as his dependent.

Also, is she can file, could she file as an EB1 or EB2 employed as a doctor?

My friend file dhis in eb3 and his employer has refused to upgrade to eb2.

You are Dec 06 PD and still waiting?? something wrong with your application?? Apparently the USCIS has provided some new numbers (as of Nov 11) of pending/adjudicated EB-485 cases per service centers. Anybody checked these out for the number of EB3 in them?? Just curious how many EB3 485 is pending/preadjudicated. 3012 will help anyway, whatever the situation be.

I got my green card in July and had to send them back on Aug 8th because of a typo. I filed I-90 on Aug 8th, 2011 and havent heard anything back.
