yes you can.. FP has nothing to do with EAD/AP. However, FP is required to get a GC.

This is all under the assumption that the haloed lines have not been crossed; honestly no one can be sure.
So I believe the first half of April will be a true litmus test. Even RFE cases are not getting approvals now and EB2 ROW cases are finally picking up. Letís wait and watch.

What I understand is that you are saying we may have about 5K PWMB cases and that is what they will process going forward whose PD is until Aug 15 2007. But this should be effective May bulletin onwards i.e. May 1st onwards only... Per April bulletin, everyone with PD May 2010 and earlier are current. Wouldn't there be any cases already assigned with visa numbers? Does it mean they will re-assign or just hold them off... we don't know that number, so does this further reduce 5K?? Or, did you mean that even in April, they will not approve any more cases beyond Aug 15 2007?.... all would make sense if the retrogress dates they announced were effective April 1st but that is not the case, however.

In my FP notice which I received in mail has two sets one for I-485 and another one for I-765. If my I-765(EAD) can be approved without finger prints then why they would they send a notice for I-765? Please forgive my ignorance. I am very new to this process and trying to understand how it works. Thanks for the responses.

I was confused too at first about the EAD approval before the FP appointment but then I saw many posts so thought it's common.

Let's see if it's a 1 or a 2 yr EAD/AP

I got EAD without FP, but my wife got EAD with FP. so they can go both ways.

I've a different issue though..my 485 case not found on the uscis site yet.

Did anyone from NSC got EAD/AP approvals or FP Notices with 2010 PD's? Usually How far behind is NSC compared to TSC regarding EAD/AP/FP processing? any ideas?...

I got EAD for just 1 Year and my PD is 10/2008.

This is common ... it's simple, if you haven't had your FP done yet and received EAD/AP combo card, EAD card will say 'Fingerprint not available'. In case, you already had FP done and later receive EAD/AP, you might see fingerprint on EAD card itself.

Consider it this way.... it is a "nice to have" for EAD (765) but "must have" for GC (485).

Now, how does it affect travel on AP et all... I'm not too sure on thsoe details... gurus can chime in here.

Unhappy Will PWMB's with priority date <15Aug be processed this month?

Hi Teddy ,
Now that the third quarter has started will USCIS start processing I-485 pending for people with priority date before 15th August 2007? Where can we find answer for this?

dude, they should have been processing these few months ago... but the doofus(es) chose to approve 2008 PD cases.... as late as Oct-Dec 2008 cases... honestly, nothing against the folks who got approved (I'm happy for them) but that just tells us how screwed up this syetm is... case approval is strictly by the visa bulletin and who is current as of that month. That said, for April, if you see any PD (prior to May 2010) getting approved, don't be surprised. And like Teddy mentioned, gotta wait and watch.... let's see how many and what approvals comes by in the next couple of weeks plus the May bulletin (which we all know is going to be retrogress to Aug 15 2007). And even then if they are unable to clear up PWMB cases, then God knows what next to expect.

Thanks for the update mzc123. Hope we will be able to see some updates in the other site from users getting approved this week, I see only one approval from April as of now.

IV Admins - Is there a way that we can take this to the attention of USCIS - that cases from before August 15th are still pending [including cases replied for RFE]? And try to get an answer on, what is the order used by USCIS to process / approve cases?

Defintely feel for you and all PWMB's they should be approved on humanitarian grounds now. What Iam saying is that the total SOAF we can expect now till Sep 2012 is 5-10K. Only ~ 2K is PWMB and porting. So there is high likelihood of all PWMB cases being cleared by May when the official retrogression kicks in or April when itís unofficial via the memo.
