First off: I am a big supported of Visa recapture and I think that the quota is very low anyways and should be increased. For that matter I am also in favor of granting some sort of legal status to the undocumented. Although a few humanitarian reasons can be thought up for this but I support this purely based on economic principle. Now that I have already said that I am not an anti immigrant. Please try to answer my question not just disregard it by branding me an anti.
The document from number USA site claims that there are no visas available to recapture because they are used every year in the next year. try reading the law here: 8 USC § 1151 - Worldwide level of immigration | LII / Legal Information Institute On the first read it does seem that they are right. Can any one let me know where are the visa that we want to capture. |

The rules to calculate the FB allocation are quite complicated. What this means is that it is possible for spare visas to be available from EB from the previous year that do not increase the FB allocation at all. Even with the extra EB visas, the calculation results in a figure less than 226k and the FB allocation defaults to the minimum 226k figure. When this happens, neither EB or FB ever benefited from those visa numbers and they were lost completely from the Immigration system. Of that number, 180k have already been recaptured (130k under AC21 and 50k for Schedule A). The balance, after those recaptures, is the 219k figure. Since they were truly lost to any immigrant, that negates the Anti's argument put forward in the NumbersUSA document. Apologies for the off topic post. |

I was just checking the LIN numbers and many folks with numbers ahead of mine have been greened. Most of them today's date. Ofcourse they could be folks with earlier PD than me (august 08) and have submitted the application later but it appears there is some approvals going on?? I also did notice atleast 5 with rfes like mine.

My dates are in the profile and I am still waiting for the approval. FP finished, got my EAD/AP combo card for 1 year. Updating this just to get an idea who are getting approved....
