Default Change Employer in 8th of H1B

All,

Presently working on H1B. My labor and I -140 got approved but not yet applied for I-485. My green card is processing under EB3 and my priority date is March 2003 . Right now working on 8 th year extension. Can i switch my employer to join some other company. If i join a new company what happens to my current status ?

I really appriciate if some one reply on my case.

I don’t think you can change employers now, you can change 180 days after you apply for 485. You might have to wait for a couple more years for your PD to become current, in the meantime if someone says that you are dumb to be with the same employer, ask them to ‘f*** off’. There is nothing much you can do unless you want to forego your current GC application.

if you change ur company..you have restart ur GC process...
but if you find a good lawyer..you may be able to port your PD!
but u have to make sure u starte ur GC ASAP!

Hello yyenkey,
Here is my take on your case...You will be able to get 3 year H1B extension since your I-140 is approved. If you are desperate then you can switch to another employer with this 3 years H1B extension and start a new GC process and port your priority date to your new I-140.

Consult a good lawyer before u take a decision....

its a bit of a grey area, but so far USCIS has not taken a position against this.
You should be able to:
- get a 3 year extension with some other employer
- keep your PD when you restart GC with new employer.

I was in the exact same boat last year, and almost did the move (then dates became current in the infamous July VB and I stuck it out a bit longer with my current employer)
