Default No Minimum Number of Hours for H1B Workers.

There is no minimum number of weekly hours for an H1B petition. There are some H1B workers who hold several part-time positions. This is common particularly in academic settings where individuals may teach part time, or where a single position may be funded by more than one source. (This requires multiple part-time H1Bs.) Thus, potentially it would be possible to obtain an approval of an H1B for just a few hours per week.

Since nothing in the regulations specifies an amount of time each week that an H1B worker must work to remain in status, it is possible to be in status as an H1B worker with a part-time job. There is no guidance on this matter as to any minimum hourly requirements. There is some old guidance on H1B workers attending school, which states that it is permissible, but that the H1B employment must be the primary purpose for being in the United States. This might be helpful by analogy, but even this guidance does not specify hours.

H1-b 5.5 years, I-140 approved 1.5 yrs, I-485 pending almost 2 yrs, priority date just got current (JUL2004). Got laid off and will have January check as last pay check. Spouse is on H1-B, whose job is relatively secure for the short term, whose I-140 approved as well but didn't submit I-485 (PD is about beginning of 2007).

1) EAD/AP expire at the end of March. Should I renew EAD/AP now? The company will not do it, if I apply it on my own will CIS notice this and send me an RFE? If they do send me RFE asking for employment verification letter can I fax back a letter (I believe my company still counts me as an employee now) without letting them know I got laidoff?

2) Regarding H4 application: what's the best way to do it, apply on my own or use an attorney? Do I have enough time to do it in one month on my own?

3) If I find a new job quickly, given that I'm in my 6th year of H1-B, will the new employer be able to transfer my H1-B?

4) If my 485's approved but I don't get the card mailed to me at the time I start my new job (if any) is there a problem?

Default On Dependent EAD. Impact of filing for unemployment?

Hi,
I was using my (dependent) EAD card (based on pending I-485 application of wife) to work and got laid off recently. The question I have is if there will be any adverse impact on the greencard process if I file for unemployment benefits? Any inputs appreciated

Default Layoff - Please help

I’ve been laid off as of Friday last week.

My employer started laying off people an year ago and there were too many cycles so far. I was immune to all those layoffs until Friday. They eliminated everybody in my team, 15 people in total.

I am in the final stage of my GC and I have 2 year EAD. My H1 is expiring in March and my (ex) employer already paid my Attorney for the 3 year extension. They have decided to extend my H1 and paid for the expenses. But in the mean time, they were forced by the investors to show profitability and hence the layoffs.

My (ex) employer is based in Massachusetts and my Labor Certification was done from this location.
I have received job offers from some of my employer’s clients. However, they are based in other States (CO, OH & WA for instance) and they might not be able to do my H1. One of them is interested in hiring me on a contract basis, since they had frozen new hiring.

Is taking a job outside of Massachusetts impact my pending I-485? or Will it violate my Labor Certification conditions? I couldn’t find an answer for this anywhere.
Also, can I take contract jobs for the time being?

I sent out an email to my Attorney with all these questions. But, he is not available until Tuesday next week.

What about salary requirements?

I am planning to move to a State, where the cost of living is low and hence the salary is lower than what is specified in my LC.
Is that an issue?

All,
I was laid off and since then I have been receiving my unemploment insurance from state of texas. I have my EAD and have been actively looking for a job. Now there is a family emergency and I have to go to india. Is it legal to claim my employment insurance from india? Will there be any problem if I claim my benefits from india?

As long as your job responsibilities are same or similar, your should be good to go. You are probably confusing between Labor Certification and LCA. If you use your EAD, you can work anywhere in the US. LCA filing is done for H1B and there you could specify the job location but not in a Labor Certification filed for the GC process.
