Default All I140 questions and discussions here

Hi:

Since PDs have jumped 2 years, my PD 2001 Eb3 has become current .I have 2 questions, what are the requirements of I140 filing as I am going to file both I140 and 485 together.

Secondly..I have h1 approval till Oct5, 2007 and also passport stamped(vancouver) till Oct5, 2007. The question is that I do travel out of country often and if I file for H1 extension(hopefully last) does it matter whether I travel outside the country because my pasport is stamped till Oct5, 2007.
I had heard something about validity problem for H1 extensions if one has to travel but since my passport was stamped, I am not sure. Please throw some light!

I do know that after Oct5, 2007 I won't be able to travel until I get another stamping done.

Default ok to claim experience after my BE?

I-140 might decline:

I got my labor done (Eb-2 RIR) and I applied for I-140.
It was mentioned in the labor application that the position needs Masters plus 3 years experience before joining my current employer.

I have 3 years "full time" experience after my BE and Masters with no experience

My question is it ok to claim experience after my BE? I am under impression that MS+3 mean you should have 3 years of experience after MS.

Default Labor, I-140 and I485 issue

Hi,

I have cleared my Labor and I-140 in EB2 category. My priority date is February 2006.

Now I got a pre-approved labor certificate jan-03.
If I want to start new filing using this labor, Do I need to clear my I-140 before July 17, 2007. If that is the case, there is no premium process for I-140 now. Am I going to be in trouble. What is your suggestion to solve this issue.

No, you just need to file I-140 before July 17.

There is a Premium I-140 process now - it costs 1000 US dollars

Some one from lawyer's office told me that I-140 premium process is not in effect still. I din't ask for the reason why they removed that process. If that is still available I can ask for the premium process.

For labor substitution cases, USCIS stopped premium processing from 05/18/2007.

Hi,

Lawyer's secretary told me that they are going to file new labor in premium process, I-140 and I-485 all together. Why they need to file a new labor again when they have substitute labor. I need brief explanation for my understanding.

Hi,
My wife and my child are in India now for vacation. Do I need them here to file the case as it includes I-485. Do I need them to call back.

Or can I include them in file after they come back. Please let me know.

I have worked at my curent company for almost 5 yrs. When applying for i140 can i use the experience that i gained at my current company when applying. I have a three yr degree and want to combine it with my work experience but the only place that i have worked is with the company that is going to sponor me. Please advise.

You have to get letter from your current employer as you do not have prior experience and submit with most updated resume.

There seems to be some confusion regarding this. I guess filing I-140 before 7/16 should suffice.

05/21/2007: DOL Labor Certification Substitution Elimination Rule Update

There is a confusion on the cut-off date for availability of the substitution of beneficiary of the labor certification application which has been certified on or before 07/16/2007. Specifically, issue is whether the substitution I-140 "filing" is sufficient on or before 07/16/2007 or the substitution I-140 must have been approved on or before 07/16/2007. The answer to this question is critical since the USCIS suspended on 05/18/2007 premium processing services for the substitution I-140 petitions and regular processing times for I-140 petitions are hopelessly backlogged at this time, and the chances of most of the substitution I-140 approvals for the pending cases in regular proceeding before 07/16/2007 are very slim. This question has been raised because unlike the proposed regulation, in the final regulation the DOL removed the language "I-140 filed" in the preamble. Sources indicate that the DOL is expected to release announcement on this issue within this week to clarify the rule which the DOL intended in enacting the final rule. Do we need an original approved labor to file the I140? Who gets the approved labor, attorney? Or Employer?
