Hello!

It may be worthwhile to have a list of the different types of RFE's that one can get after filing I-485.

I request members to post their experience with the following info:

- After how many days, months or years of filing I-485 did you get RFE
- The subject of the RFE
- The resolution/response of the RFE
- Did the RFE arrive at your address or your employer's address

1. Immunizations, Medical records
2. Proof that future job offer is still good - salary and job profile
3. For people on J1: Evidence of compliance with 2 Yr. HRR OR Proof of Waiver
4. Proof that marriage is geniune
5. Proof for ability to support dependents - Assets, Tax Returns, W2 etc.
6. Evidence related to birth - certificate, non availability, school records, affidavits etc.
7. Any RFE's after using provisions in AC21?

Awesome! It makes a good read.

But note that this doesn't cover all RFE cases.

For example, certain case officers will send a RFE on a birth certificate if the date of registration is not within one year of date of birth, while other case officers will not have a problem. If you look at the CIS Standard Operating Procedures, all it states is that the birth certificate must be timely registrered. Don't know who decided "one year" was timely!!!

Another example, according to the CIS Standard Operating Procedures, the case officer should not issue a RFE if the TB skin test is +ve but the chest x-ray is normal. Still, some case officers have sent a RFE asking for evidence that the applicant is undergoing the nine-month treatment!

Bottom line, is do all that you can to be assured of a smooth adjuication. But there's no guarantee that one case officer will not come up with his/her own interpretation of the CIS Standard Operating Procedures and start a new trend for RFEs.

Note that this SOP is from September 2001 (see bottom of contents page http://www.imminfo.com/resources/cis...erview-1.html). We hardly need reminding that a lot has changed since then.

We need to dig up the current version of this doc.

First and foremost, CONGRATULATIONS for your foray into parenthood.

Now about the RFE, I can only guess that when USCIS sends a RFE for your vaccinations, you would need to take the vaccinations from a USCIS-approved civil surgeon (I-693 and the supplement) and send it to USCIS. Just make sure that your I-485 has a note from your OBGYN about why you are not taking the MMR shot at the time of applying.

Default MMR vaccination-RFE

Hey Jayant,

I was not aware of this.We already sent our papers to our lawyer.I told orally during my medical appointment to USCIS civil surgeon and so he avoided MMR vaccination ,he marked the "contraindication" in the MMR coloumn.But we have not taken any letter from our OB/GYN and i didnt knew that we have to take letter from her.

Will this be an issue?????

I got RFEs for:
1. Show evidence to prove legal non immigrant status maintained in the US since Nov 2002
2. Birth Certificate (I did not submit it before. I submitted only the affidavits from my parents and Birth Certificate issued by the Indian Consulate in NY).

That means nothing. They probably are looking at your documents for possible pre-adjudication.

You bring up an interesting point. My idea about the USCIS process was very similar to yours but couple of months ago I got in touch with a representative and according to him, they process the applications by notice date irrespective of priority date. Once priority date becomes current then they issue GCs to application which have been processed already.
That is the reason why I think so many people are getting RFEs these days even though their dates are not current.

Anyway atleast you know your application has been touched and worked on, that is something we should be happy about.
