Default I-94 issue please help

Friends,

My H1B is valid till april 2012. The I-797 and attached I-94 with 797 have the validity date till april 2012. Last time when I was entering US the immigration officer marked oct 2010 in the white I-94 card as my passport was expiring in oct 2010. Recently I have renewed my passport and my passport is now valid till 2020. Do I need to do anything ?

Some people are able to correct I-94 via going to the entry airport and speaking to USCIS. You can try if they will change the date for you.Your visa in old passport is still valid.

I am in same boat. Let me know. I haven't sent my passport for renewal. I will do next month.

Go to local airport and look for DHS office. Find an immigration officer and explain him your situation. They have the ability to correct I-94 right then and there.

Definitely, you need to get that I-94 extended until the I-797 validity or else it will be illegal to stay beyond that oct 2010 date (as it is the I-94 date and not anything else that determines the length of stay in this country).

Two options: you can talk to the airport CBP office or the local DHS office to see if they can extend it (like posters have suggested). If not, you may need to take a trip across the border to Canada/Mexico (depending on which is closer to you) to get a new one with the correct date. You can search the forum and will find a few threads with info as to which airport CBP offices actually correct them on-site.

For my case (see above) i talked with Seattle CBP and new york CBP office and they have conflicting advise:

1) seattle: I-94 will not be issued by CBP. Leave US enter through canada or mexico to have a new I-94
2) new york: As the I-94 attached to my I797 shows april 2012 I am fine (even though the white I94 paper attached to the passport says oct 2010). I am not violating any law or overstaying even if I dont leave-reeneter after oct 2010.
