Default Can I do 2 jobs on an H1?

I'm currently on a H-1 B visa going to India to get it stamped this Dec. What I want to know is, if I can work next year part-time for 3-5 hrs a week on another job while continuing my present full-time job too. Is this legal?

You can work 2 jobs as long as you have...2 H1 visas, one for each job!!
That could be 2 part-time or 1 full time and 1 part-time.
I believe there could be a problem if you have 2 full-time H1 jobs at the same time...

Default I have been doing 2 H1 jobs for the past 2 years..

I started my 10 hr./week part time job 2 years back (I was 4 years on my primary H1 by then). We filed a 2nd H1 and had no problems getting it approved - we got a 2 year approval aligned with the primary H1s 6 year expiry..

My both, the primary H1 and the 2nd H1 are up for renewal in Jan 07 & April 07 respectively and I am also up on the 6 years on my H1 by then.

I have an approved I-140 from my primary H1.

I have a question which I hope someone can help me answer. Will the 2nd H1 also qualify for the 3 year extensions, just like the primary H1 based on the I-140 approval on the primary H1?

I am guessing yes (it sounds logical to me), but am not sure...can anyone confirm?

I don't intend to get a second H-1.. The second job that I want to do is just 3-5hrs a week and dont want any sponsorship for it.

U dont have an option. If you want 2 paid jobs, you need to have 2 H1s. I dont know of any exceptions to this rule.

Default It would be illegal to work a 2nd job without proper H1 documents for it..

Even if you work 1 hour a week, you need an H1 to be able to put on payroll at the other company. Otherwise, it constitutes illegal employment.
