Default Attorney /Experts please help

Hi,

I would like to get your views/ advice on following matter

I am H1B holder (company XXXX)and my greencard petion is pending. I just came out of US for a vacation for 2 weeks. Planning to extend my vacation for some time (may be 6 months - 1 year) due to some family problems.

My questions are
1. How long can i extend my vacation,Is there any time restrictions?

2. Will i be able to join some other company (company YYYY) in India for my time here, may be work for a year and then go back to US and work for same h1b employer.(company XXXX)---Is this cause any problem for my H1B petiion /Greencard process)

Please advice

Default Come back before your visa expires. but...

You can stay as long as you want. But come back before your H1 expires. you can work for same company. it will be better when you come back. if you stay long then immigration office may try to verify if you are still working for same employer who processed your H1. Some big companies will cancel your H1 visa so you will have to get new H1 (visa stamped) and enter.

You said your green card is pending. You will have to keep renewing your EAD/APs. It will be wise to be in US because you will be able to respond to any RFEs. We will never know what will happen.

But ultimate decision is yours!!
