Default AIR INDIA and Direct Airside Transit Visa

Hello Folks

I have expired H1b stamp in passport with extended I 797 .. Do I need Direct Airside Transit Visa while going through AIR INDIA from EWR ( NJ ) to India via Flight AI 144 which has stop at London.

I called AI toll free no and she said I need valid USA visa .. I told that I have extention but not stamp in passport and she was aware of it.

my recommendation - dont rely on airlines help desk. Please check this out and call/ email consulate if needed

Also - as a general rule - an extended 797 is not the same as a Valid Visa.

Another suggestion - when we can - we should stop patronizing airports in countries which have these complicated visa rules...(i say this despite the fact that I have GC and generally dont have the transit visa problem).....for example - flying from Newark - Continental offers direct flights to delhi and mumbai..... and from the new york area - Air India and Delta also offer non-stop flights.

even if we spend couple of hundred extra dollars on ticket - its more than made up by the hassle and visa fees involved in getting a transit visa.

Elaborate a bit more. Did you have trouble while going to India or when coming back with AP ? It seems from some who were lucky not to be asked while going to India but insisted on having a visa stamp and would not accept anything else in lieu of that. But, I did read and DATV instructions cover the US to India part as well. Just was curious if BA and AI insist on checking your stamp while you proceed to India?

I had checked this earlier. You will need a transit visa if your visa stamp has expired. I797 approval notices do not count. Avoid going through London!!!

I also was in the same situation and had to get transit visa.

Default Go thru Frankfurt

London has strictest rules. You need a valid visa stamp or transit visa.

go thru Frankfurt, AP is fine. I know from chicago, AI flies alternate days thru London or Frankfurt. Two years back I flew by AI with expired visa stamp (thru Frankfurt), while coming back I had my H1b stamped.

Last month again I went to India and came back by Lufthansa with AP (H1b visa stamp expired again).

Usually AI flights do not require change of planes. The same plane continues its journey after a short layover, all those continuing onward journey normally would be asked to stay put. Since you are not changing planes / terminals, I think you do not need the DATV even with an expired H1 stamp on your way out. At least I didn't back in 2006.
