Default I-94 expiring on 15th April 2009

- my I-94 card is expiring on 15th April 2009
- my H1b petition is expiring on 01/27/2011.
- my old h1b visa expired in October 2008
- When I entered the country in Feb 2008 they gave me my I-94 validitiy only till 15th April 2009 because my passport was valid only till 04/15/09


If i go the CPB office, will they extend my I-94? What are the chances ? Any particular documents (apart from my H1b petition and my new,old passports, I-94) I should take with me?

Above all my wife is expecting in may 2009 so i dont want to take any chances

what would you suggest?

I am not very sure as your visa is already expired. I am not sure why you are waiting till the last minute. if you try out at the earliest, you can go for alternate in worst case...

Not 100% but here's what I know:

You can file an extension using I-539 (see link)

However, your passport must be valid for the entire stay in the US. Hence, you're in a jam due to the dependency. What I'll do is to contact your country's embassy/consulate and renew your passport (pay for express service if available) and then file I-539 (check if you can file online).

I have the new passport , i got it around 4-5 months back.

Thanks for the link. I have contacted my attorney, let me see what he says

My attorney is filing for a h1b extension. The CPB office refused to extend the I-94, they said the immigration officer didn't do any mistake by giving you the date of 15th April 2009, he said I will have to file I-129 ( h1b petition) and if file it even before the date of your I-94 expiry you won't be going out of status
