Hello Friends,

Does transfer of H1 (7th Year extension) to a new employer pending labor, count toward the H1 quota - given unavailability of quota?

H1 Transfer or Extension is not being counted under H1 quota.

Default H1B Transfer in 7th year after I-140 approval

I want to change my company. I have I-140 (eb3) approved with 2004 pd. I already have 3 years H1 extension till 2009. Can I transfer my H1 to a new company and get a new LC/I-140 (eb2) retining my old (2004) pd?
Would some one please tell what options do I have?

You can change to a new employer based on your approved I-140 but you can retain/port your old LC priority date only if the old employer does not revoke your I-140...Otherwise it is back to one and start all over....

I don't know how it goes if old employer cancel 140 but some people in this site said ealier that you can retain PD even if your old employer cancel the 140.

Please read 27 page [ (1) Determining the Priority Date.] in below pdg file.

Thanks for the info. Anyone (or any known person) in this forum has successfully retained his/her pd after the old employer revoked I-140. There is always a chance that your old employer will revoke I-140 if you move to a new company. We all should know this before we can jump. Please post if any body has any experience regarding this.
