There is no cap for going on OPT (while on F1). When he plans to get H1 he WILL be under 'advance degree H1', unless he plans to go to a not for profit org like public universities or research institutes.

Thanks for the quick response,,,this was not for me,,,this was for my brother,,,who by the way does not understand complications of immigration,,he just knows how to play with DNA's and bacterias and Virus and what not in his lab!!

Before everyone gets carried away with this news, it is worth realising the H1B cap filling up has no implications for EB, other than maybe help a little bit since
the industry will lobby for H1B )and we could potentially piggyback on that).

What a mess!! Being highly qualified software professionals, we are still subjected to a lottery!

I am probably venting but part of the blame lies with Indian outsourcing companies that apply for a batch of H1Bs (Infy, Wipro) and the S/W engineers who have permanent jobs here are left to praying and wishing that they win out in the lottery.

I hope the senators and congressmen take some notice of this.

Default H1 CAP reached - IS J1 Option? J1 Waiver??

H1B-CAP reached.

My H1B was filed on April 2 on US-MS catagory. I have uS PHD.

1. Do you think even H1B US-MS 20000 cap was reached on April 2?

2. If 1 is yes, Is J1 an option? as i am Scientist.

3. How difficult it is to get a J1 Waiver?

I think the MS quota might have reached or it is very close to reaching 20,000. The reason being - most of the indian outsourcers that apply for H1B don't have employees having higher degrees from US. Anyways, the odds of winning "lottery" in this quota is way higher.

What a pathetic situation.

When indian outsourcers dont have employees having advanced degrees from US, haw can thy file under this (regular h1) quota.They need to wait for the whole year whether it can be reached or not, They cannot do it in April itself.

because, following companies dont want to lose positions because non availability of H1s

Microsoft
Intel
Cisco
Oracle
IBM
Google
HP
DELL
Sun Micro etc.,

They raise the concern definetly

Default H1B for US Masters CAP Reached??

1. Did the H1B for US-MS 20,000 CAP reached as well?

2. Given USCIS received 150,000+ applications, Do you know if and when H1B for US-MS cap will be reached?

3. Do you know how long a J1 waiver process typically takes for Indian nationals?

I have US PHD and my company applied for my H1B with US-MS quota on April 2nd and now i am REALLY CONCERNED that even H1B for US-MS/PHD cap is reached or not?

Please share your thoughts =- thanks
