Default H1b Transfer to a start up company

Hi All,

Please help me out here. CIO of the company I am working now as a full time employee is quitting and forming a new company. He would like to hire me for this new company. This is a start up company with 15 Million investment and a big venture capital company from NJ is also investing in the company. Would you guys see any potential problems here for H1b sponsorship?

Default H1b Transfer to Vendor

Hi, I am currently on a Company A's payroll and working at a client's place (Company B); now that Company B wants me to join them; however, there is a contract between Companies A & B not to hire the employee directly; what should be done in this case? I also have a contractual obligation to my employer not to join the client for 12 months. My employer(Company A) is not willing to let me go (though I worked for a year already). Any advise from the forum?

1. Your company (A) has you in a bind. They also have the client (B) in a bind. I doubt (B) will stand up for you beyond a point and fight any battle - unless they are really desparate to hire you.
2. Dont go against your company - they are likely to go after you legally and probably win.
3. Try to negotiate with your client (B) to pay a fees to your (A) to hire you as full time. This is probably the only way to get out of it clean and keep both parties happy.

Default Not unusual but weird

Normally vendors dont like going against the client. Especially after you have billed for them for a year already. Unofficially they let you go after 1 yr i.e. the vendor. Try to talk to your client and see if they are willing to apply pressure on the vendor to let you go. Also talk to your vendor and explain to him why you want to join client i.e. career growth, etc and tell your vendor that you can help him/her recruit more folks to fill in your position and stuff. Basically you will have to do some brown nosing with the vendor for the time being.


If nothing else works, ask the vendor what would it take to make this work i.e. money wise and stuff if you are willing to pony up some dough to make this happen.

Hi,
1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.

Here are my questions.

1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?

2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.

3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.

4. Anyother suggestions what should I be doing so that I can start working on H1 after Oct1st here and then whenever I go back to India, after 4 or 5 months I will have the Visa stamped.

Default H1B Transfer under process and Travel to India

Hi Gurus,
Right now I am working for Company A and VISA with company A is valid till September 30 2007. Company B applied for Regular H1-B transfer (Receipt Date May 12) and it is still under process. I will be joining Company B on 1st October 2007.

Now due to some emergency I am traveling to India on 11August, 2007 and will come back on 11 Th September 2007. Also I canít go for VISA stamping in India for Company B as I have not got my H1 Approval yet.

Given the above scenario, will I have any problem at the port of entry as my H1b transfer from company B has not been approved yet?

What all documents I have to carry to reenter safely?

I'm not sure if its ok to travel when an application is pending, check with some experts... but if I were you I would Convert it to PP and get the approval before travel and get stamping done... Thats the best option.

Thumbs up How to maintain F1 to H1B Status? Please HELP

Hi,
I came in Jan 07 on F1. I got my H1-B in Apr 07, but is effective Oct 1, 07. My school, NJIT, starts on Sept 1, 07. If I have to maintain a full-time student status from Sept 1 to Sept 30 then I have to pay $5,000. If I have to maintain a full-time student status from Sept 1 to Sept 17 then I have to pay $1,200.

Please let me know

1> Will it be problem if I don't take any course in Sept i.e. I am not a full time student during Sept.?

2> If it is problem then will it be problem if I drop courses on Sept. 17? What will be my status for 13 days from Sept 18 to Sept 30?

3> Is there any college in NJ/NY area which starts in Oct so that I can transfer to that college and maintain my full time status till Sept 30?

4> Any other suggestions about what I can do?

My employer has suggested not to go to India and go through H1-B stamping.

If u travel while H1 is pending then its deemed abandoned. U have to file for ur H1 again thru company B and start over the process. Rather I suggest you to convert it into premium and get the approval before you leave.

Default premium should avoid confusion and fast

You please contact the lawyer and request them to send a check for $1000 (premium processing). You will get your receipt with in 7-10 days.

My friend done the premium change (for h1 extn) 10 days ago to be part of GC race.
