Default H1 B Visa restamping after extension for 2nd 3 year period

Hi all,

I got my first H1B after my MS in Nov 2002 to Oct 2005. I have renewed my H1B for the next 3 year period (Nov 2005 to Oct 2008) and I have the necessary forms from the USCIS. Now I need to get my passport restamped. I am considering Tijuana, Mexico as I have a friend in San Diego that I want to see. However, my I94 form in my passport says it expires in Nov 2005. Now my question is:

Can I go to Mexico for a restamp? What is the procedure/risk involved?

Thanks! Any help is appreciated.

Your I - 94 Validity cannot be at a date later than H1-B. You say you got your first H1B visa till Oct 2005, but I - 94 expires in Nov 2005. I donot think it can happen

Third country Nationals can go to Mexico and get thier Visa stamped. The only thing is if your Visa gets refused for some reason, you will have to fly back to home coutry and get it stamped.

Have not heard such cases though.

Hi JSaradhi,

When you got your renewal for your H1b till 2008, you should have also received a new I-94 card with a new validity on it, probably till 2008. I know this because I also recently got my H1b renewed.

Check with your employer. They should have handed over the new I-94 to you.
