Default EB3 PD not ported to EB2 I-140

Hi,

My EB3 PD is not ported to my approved EB2 I-140. My EB3 I-140 is still active as I am with the same employer. According to my employer they requested to port the PD but somehow it did not happen. Could someone guide me what are all options I have now to proceed further.

Default your emploeyer

who did 140 EB2 to need to file 140 amendment to get PD from 140EB3...
After that you can filing interfiling request to USCIS.

you can do it yourself. you just have to make sure that both I 140 are linked to your 485 (you can do it by calling L2 officer ) and then do everything possible to pick your case by officer. (calling , congressional / senator inquiry) etc.

Hi all,

Nobdoy willing to advice on the question below ? Would appreciate if some body can give input / suggestions based on his/her experience related to steps for porting of EB3 dates to EB2 labor to be filed soon.

You need to apply for perm. After perm approval apply for 140...with copy eb3 140 requesting old Pd. After 140 approval go thr interfiling process.

it takes about 8-9 months if you file EB2 140 in premium processing.... about a year if you don't file new i140 in premium processing.

Feb 2012 - received I-485s approved & CPO emails

In my case, new I-140 and I-485s were at the same service sender. So, it didn't require aggressive pursuing. My attorney didn't even send any interfile letter through snail mail. For current pursuants with case like mine (I-485 and new I-140 at the same location) my advice would be wait for 90 days (my attorney says they have a backlog of interfiling cases and 3 months is the minimum time they need) and then open SR. Only when that fails follow other aggressive steps. Of course, gurus here should tell if that is the right approach or not.

Thanks. I think it could be the follow-up email or my call that could have triggered the process. I strongly believe that my call could have triggered it. When I called the agent told me to expect a response with in 21 days. I got CPO emails on the 15th day.
