Dec-14 2011 - 140 Applied in Premium Approved in 2 days
Jan-22 2012 - Contacted House Representative. Rep received a message from USCIS (Working on my case. Figer Prints expired and USCIS requested finger prints from FBI)
Jan-22 2012 Sent Interlink request via email and USPS
Feb-5 2012 Received a response from Nebraska USCIS. Awaiting final approver and will be approved in 90 days
Feb 29th Case approved and received 3 emails each from USCIS

My new I-140 under EB2 got approved on Feb 2nd and immediately we sent requests to link the 485 and the new 140 with old priority date of Dec 2003.

485 is pending in TSC and the new 140 is approved from NSC.

Got an email response from the TSC as follows:

"Your case is in the processing queue and will soon be assigned to an Adjudicating Officer for final processing. You should expect to see action on your case within the next 90 days. "


Does it mean that the 485 is linked to the new I 140?
Should I wait and relax and give USCIS some time to process the application or it is just another standard automatic reply of no real meaning?

This means 485 is linked to new I-140. Give it 3 weeks. You should get it within that time.

Here are my details:

++++++++++++++ EB3 Details +++++++++++++
1) Eb3 Labor-Priority Date 02-AUG 2004 TSC
2) EB3 I-140 Approved 10-MAY-2005 TSC
3) I-485 applied for my self and spouse-July 2007 Fiasco. TSC
++++++++++++++++++++++++++++++

++++++++++++++ EB2 Details with new employer ++++++++++++++++
1) No AC21 filed, but on EAD/AP status since 2008.
2) Perm Labor Applied 9-AUG-2011
3) Perm Labor Approved 20-NOV-2011
4) I-140 Notice Date 14-FEB-2012
5) I-140 Approval Date 24-FEB-2012
6) Waited till to receive actual approval notice, to confirm my old priority date is ported to new I-140
7) I-140 approval notice received on 03-MAR-2012 and confirmed that i-140 have old priority date
8) Sent email to TSC to link my I-1485 with new I-140 on 05-MAR-2012 (Around 10 PM night)
9) On 6-MAR-2012, Called USCIS customer service and opened SR. Level 1 officer courteous and open SR with out any questions.
10) On 7-MAR-2012, Got emails from USCIS that my 485 (Spouse's 485 also) is approved and CPO on same day
11 )Received cards on 9-MAR-2012
12) Finally Greened

One thing really amazed me is that, even before I sent email to ebupdate.tsc email, my case is approved. I sent email on 5-MAR-2012 night 10 PM, that means that business day is over. But my cards are approved on 5-MAR-2012 itself. So, I'm assuming that even before I took actions (EMAIL and SR), my case is approved. This is really amazing. Note that all my cases are with TSC only. I think this might be the reason.

For fellow EB3 longwaiters, it is worth to try porting. My guess is that only people in EB3 queue are a) who went to home countries for good, and still in line b) Illegals who applied during clinton period. So, these people never consider porting. People who have choice to port, better to consider now.

My 12 years wait is over finally..........

I used to browse and Rajeev forums and Murthy forums, and one time we are discussing about have separate org for immigration community. Thats how immigrationvoice born. Initially I donated $100 and joined 5 other friends to donate. After that I'm not active in this org and silently watching.

Kudos to IV, on its progress from birth to today. I wish all the best for other people and IV

Default Finally, received physical cards a month after 485 approval!

I and my wife have received our green cards, almost a month after our I-485 were approved. Ours were transfer cases from CSC to TSC. There is a known problem at TSC with such cases where the biometrics data continues to be in the CSC database, preventing the TSC system from ordering the cards even after 485 approval. This requires the IT department at TSC to manually retrieve and upload biometrics into their database. In our case, sending emails to the TSC NCSC follow up email helped. The immigration officer who responded to the emails put in a request with their IT Helpdesk to retrieve and upload our biometrics, which finally triggered card production within 2-3 days of the request. We did not have to go for new biometrics.

Finally, I can officially call our GC journey over. Good luck with those that are waiting. For EB3 folks...port to EB2 if you can, else put your full force behind HR3012.

Default EB2 Job Description

Hi All,

With inputs, information and inspiration from members of this post, I have been approved for refiling of new Labor under EB2 this time. I have a few questions on job description (jd).

My EB3 was filed by my previous company and the jd mentioned SAP functional expertise with bachelors + 3 years of experience. The previous company was bought out by the current company and it became successor in interest and continued my GC process of extending EAD/AP. Now this company has decided to sponsor GC and file labor under EB2. Also, has agreed to mention bachelors + 6 years.

Question is:

1) Does my jd have to different by more than 50% because the new co. is a successor in interest or can it be nearly same since they are actually two different cos (am confused on the need for 50% difference in jd...how is this done for SAP functional expertise .

2) If they dont have to different, then should I use same SAP functional expertise as before with some inflation for number of years, project management etc. ?

3) Should I narrow the jd down by using specific areas / technology I have done in my area or should I leave it broad as are normal jds?

4) Do all the specific things mentioned in jd need to be mentioned in the experience letters too?

5) What is NIW and how is a labor filed under NIW?

Sorry, I have a lot of questions but hopefully pundits on this forum will have all the answers too.

Default NSC - Time for approval after being assigned to officer

I received following email from NCSC Followup to my query (with subject I-485 out of processing time)-
At this time the case is assigned to an officer. Although assigned, we cannot predict the date the case may actually receive review. If you have not received a decision or other notice of action on this case within 60 days, please contact us for updates

Can anyone tell me how long it takes to receive magic mail? My case is at NSC. Thanks

Feb 2008 - First Fingerprinting Notice
2008-2009 - Somewhere in this time frame, my cases were transferred to Nebraska due to work load in Texas
Apr 2009 - RFE on I-140 - Company's Tax Documents, proof of financial ability etc
May 2009 - Reply to RFE submitted
Jun 2009 - Second Fingerprinting Notice
Jun 2009 - I-140 EB3 Approved
Jul/Aug 2009 - RFE on wife's I-485 - Proof of bona fide marriage
Oct 2010 - Third Finger Printing Notice
Nov 2010 - L1A applied
Dec 2010 - L1A Approved
Jan 2011 - EB1C I140 Filed with request to capture Feb 2007 Priority Date - Texas Service Center
Oct 2011 - RFE on I-140 - Proof that the company has been doing business in 2011. Details of the duties performed at offshore, org charts etc
Dec 2011 - Reply to RFE submitted
Jan 2012 - I-140 EB1C approved with Feb 2007 Priority Date
Jan 2012 - Interfiling Request submitted via Phone Call to L2 officer. L2 Officer told me that my new I140 is at TX and I485 are in NE. The two files would have to be merged which could take 30-45 days.
Jan 2012 - Lawyer asking $600 to process interfiling request - told them to F*** off
Jan 2012 - Formal Interfiling letter sent to USCIS Nebraska along with copies for new I140 approval notice and I485 receipt notices.
Jan 2012 - Formal Interfiling email sent to all 4 USCIS email addresses.
08 - Feb 2012 - Received email from USCIS that files have been merged. But the fingerprints have expired.
Feb 2012 - Submitted request for congressional Inquiry
29 Feb 2012 - Congressman's office received information that USCIS is waiting for fingerprints to be refreshed from FBI. This may or may not happen and it could take up to 30 days. USCIS cannot issue a notice for new fingerprints until they hear back from USCIS.
06 Mar 2012 - Congressman's office informed me that my finger prints have been refreshed. No need for new fingerprints and
USCIS does a monthly sweep to pick up all cases which are ready for adjudication. My case was not included in the last sweep.
USCIS is waiting for the next monthly sweep to happen which should pick up my 485 cases for final review. They asked us to wait for 30 more days.
Congressman's office offered to automatically followup again in 2 weeks if we do not hear back from USCIS.

This is my situation. Company A filed my labor/I140 under EB3 category and switched to company B using EAD. I have approached company B (my current employer) for refilling my labor under EB2 category. Do I need to convert my EAD to H1B if company B wants to file labor once again?

Default Not necessary.

You are not required to change to H1B. You can upgrade to Eb2 with EAD.
But it is a different thing that H1B is always a better status than being on EAD.

Default EAD reamins good

Your EAD remains good until your current I485 is pending. It has nothing to do with new labor or new I-140.
