Hi All,

My 485 petition is pending with Texas Service Center. My current (Initial) EAD and AP expires on July 31 2008. I have 2 questions. Can anyone please answer?.

1. When can I apply for renewal?.
2. What is the mailing address?.
I live in Colorado. I-765 Instructions says I have to mail it to Nebraska since I live in CO. But my 485 pending with Texas.

1. Is it true that one can apply EAD 180 days before expiration of EAD?

2. What would be the start date of EAD if it gets approved before the expiration date of current EAD?

3. What happens to EAD application when Biometrcs (FP) are expired?

4. If USCIS cannot issue EAD say over 150 days, will they issue an interim EAD? NO? Any appeal process for pending EADS over 150 + days?

5. Is it true that one can continue or start working immediately with the Receipt of EAD for 90 days (max) with new I-9 Recipt Rules?

2. start date would be the exiration date of the current EAD
3. Nothing. Renewals do not require FP
4. The USCIS is required by the federal regulations to issue an EAD within 90 days or to issue interim EAD. If you do not get anything, take an infopass appointement and ask them to follow the procedures outlined in the USCIS memo from 2006.
5. No.

I didn't file initial EAD and AP along with 485 in June 2007. I filed it 2 months later. I filed the applications with Texas Center since 485 was pending with Texas. I was told to do so by my lawyer.

Did USCIS change the rules?.

Default Pre-Aug 17 2007 EAD Filers - Online EAD / AP Renewal

For all the Pre-Aug 17 2007 EAD Filers - Online EAD / AP Renewal is available, seems we can file EAD/AP together online but need to file the fees also not so for after Aug 17 2007 filers. We can do so 120 days before expiration of current EAD and the Photo + Fingerprint notice will be send by post to go to ASC for completing this as part of the renewal. Search for I-765 and I-131 on USCIS website.

Can people confirm that EAD can be renewed at the most 6 months before the expiry date and not more. Please state the source of your information.

I know, the source is not very reliable and it does not say whether more than 6 months is OK, but that's all I've got. There is nothing in the regs regarding this.

Are you saying that pre-Aug-2007 EAD filers cant file BEFORE 120 days ONLINE?

EAD renewal to be 120 days before expiry not 180 days as most have assumed, please check the expiry on your EAD card and apply only when its 120 days or sooner for the card to expire. Checkout the following news from AILA.

If you eFile then you will get a notice to go to ASC for biometrics & photo.

* AILA has reported that it received a notice from the USCIS that any EAD renewal application which were received on or after 01/29/2008 that was filed more than 120 days from the date of expiration would be "denied" for filing too early. We need clarification, though, as to whether the consequences will be "denial" rather than "rejection." Considering the fact that the filing fee is expensive, if it is denial, the filers will lose the filing fees paid. Please stay tuned for the clarification.

Exclamation EAD expiring and going to get terminated

Working on EAD for past 1 year.This is my 3rd renewal and is pending for 69 days today
It is pending at Nebraska
I am the sole earning member of the family of 3,send 2 expedite request and letter explaining the situation.
Although i do understand i delayed in applying the EAD application.However the fact remains that i will be terminated on next tuesday Feb 12th and will have to wait until i get the renewal by mail
Went to infopass in san francisco,lady said they cannot do for EAD's its under process.
is there anything i can do more?

Do we need to have a Job at a time of EAD filing? If one gets layoff, still can he/she able to file EAD if I 485 is pending for more than 180 days? Please advise.
