Default Has USCIS removed 120 days requirement for AP?

If the requirement of filing AP within 120 days of current AP expiry date is still there it will be very difficult to apply for EAD and AP both at the same time. Example. If EAD expires end of April 2011 and AP expires after Sept 2011, it will not be possible to apply for both EAD and AP at the same time.

I filed for my EAD and AP renewal together on Dec 20th. Both the EAD and AP were renewed on Feb 23, 2011 but I did not get them both in one card. I thought USCIS is issuing both EAD and AP in a single card starting Feb 2011. I got the EAD renewed for 2 years, but the AP was renewed only for 1 year, and that too in paper form. Does anyone have any idea why this should be the case? Should I call USCIS, and ask about it? Pls suggest. Thanks.

Default Ead ?

Does your EAD say "can be used for reentry" or "Serves as I-512 Advance Parole" ?

Thanks,
Yes, I have e-filed EAD and AP together couple of times before .

Go to the USCIS site,
Click on Forms->File My Application Online (E-Filing)-> Instructions for Electronically Filing Form I-765.
To e-file AP you need to e-file it concurrently with the EAD. Here is that part of the instructions from the USCIS site.

Hope this helps.

Quote:
Concurrent E-Filing

E-Filed I-765 applications can only be concurrently e-Filed with the following applications under the following conditions:

I-131 application, only if the I-765 beneficiary is requesting an Employment Authorization Document on the basis of a pending I-485, Application to Register Permanent Residence or Adjust Status ((c)(9) Eligibility Classification).
Please note: If you wish to concurrently e-File an I-765 with an I-131, you must fill out the I-765 first

What kind of supporting documentation needs to be sent to USCIS when you e-file concurrently for I-765 and I-131? I believe; one needs to send
1. Reference page (of the e-file application)
2. Copy of existing EAD (front and back)
3. Photographs (2 for EAD, 2 for AP)

Is there anything else?

I also sent the flap from the strip of paper that the old EAD card came attached. It says "save this and mail with the renewal to expedite processing" or something to that effect.

I did not send any photos for the EAD. Only for the AP.
Also, I believe that I included a copy of the I485 receipt notice.

Yes, as initial evidence for AP: The passport photo-page, I-94 and I485 receipt.

I sent everything that they asked for in the instructions pdf. Nothing more, nothing less.

Hope this helps, and good luck to you.

Red face situation with AP renewal

Folks, can you help me out with this situation of my AP renewal. This is my situation:

(1) My current AP will expire July 4, 2011.
(2) My current H1B status will expire on August 22, 2011. My employer is planning to apply for the extension of my H1B asking that extension begins August 23, 2011 for another 3 years).

So, my questions are: (1) In this scenario with my current H1B expiring in about 2 months from now, should I apply for the renewal of my AP? (2) Or, should I wait for my new H1B extension to arrive and then apply for an AP (I fear that if I send my AP renewal now on the basis of the near expiring H1B, my AP renewal application might get rejected).
Please let me know.

rimpi,

I don't see how expiring H1B could lead to your AP renewal getting rejected. I am guessing that AP is based on a I485?

I would go ahead and file for the AP renewal.

Default Updates

Here's my experience.

Situation: My existing EAD is to expire on 05-Oct-2011 and AP had expired long time ago. This was the first time I had to file on my own (earlier the company lawyer used to do that)

Date of e-filing EAD and AP together (for myself and spouse) - 15-June-2011 (made the payments using Credit Card while filing the apps)
Received notices for all 4 cases (from TSC) - 22-June-2011
Sent all supporting documentation to USCIS using regular mail - 23-June-2011
Received notice for fingerprinting - 30-June-2011 (The notice was only sent to me; not for my spouse. It was probably because I made a mistake while e-filing EAD. I accidently put in "US" as my country of birth . In order to correct the mistake; I sent a letter indicating the mistake and the required correction along with my supporting documentation)
Date for fingerprinting notice - 15-July-2011 (process was smooth; I got out in 15 mins; no questions asked; only carried the notice and passport for identification)
Date of approval of EAD - USCIS sent me a text message (I had signed up for 'Mobile Alerts') on 18-July-2011. We both got EAD that are valid for 2 years.
Physical receipt of EAD cards (for myself and spouse) - 23-July-2011

Even though we had e-filed concurrently for EAD and AP; we have only received our EAD cards (which was more critical anyways). We are yet to receive AP for which I would update as soon as I receive those.
