Congratulations !

My company lawyer is filing my I-485, I-765 and I-131 but for my spouse I'm planning to file myself due to steep fees. I have following questions/clarification on I-485 form. Appreciate your help !

Part 1 : Current USCIS status. Should I just write the name of the visa category e.g. H-4. Should be H-4 because that is what is written in I-94.
>> Yes, u need to specify H4 if that what is what your spouse is on currently
Part 1 : US Social Security#. Should I write ITIN instead of SSN (spouse doesn't have one) or leave blank. Should be left blank but some people have stated otherwise.
>> AFAIK "NO", if your spouse does not have SSN then don't put it as ITIN is for tax purpose only
Part2 : Application Type. It should be (b) for spouse of principal applicant(based on I-140). Correct?
>> YES
Part 3A: In what status did you last enter? DEPENDENT SPOUSE OF A TEMPORARY WORKER(H4. Right answer ?
>>YES
Part 3B: Applying with you ? Can I answer yes even if applications are going in different packets. Lawyer versus self-application.
>> NO , AFAIK as you are sending applications separately

Also besides DoB, marriage certificate copies what other docs need to be submitted for dependent application.
>> As you have to show spouse's relations to primary applicant which is you then these docs are sufficient
Thanks,

Question

One last question. If I have to say that No I'm not submitting applications together with spouse do I need to wait to get my application receipt before I can send spouse's application ?

Check the evidence needed in the 485 instructions as mentioned in item 14, page 4 http://www.uscis.gov/files/form/i-485instr.pdf

Default Please Help I am in the same boat as you were

Hi,
First of all Congratulations. I have my PD current now and i am working for employer other than who sponsored me. I have spoken to my ex-employer (sponsor) to request for I-485 application but it seems he is not ready for this. Some time he says he will apply and then next day he change his mind. I have all the required documents that you mentioned in your post such as Employment offer letter etc. Would you be so kind to answer following question so i can take my next step. Thanks so much for sharing such an important info.

Do I need to tell him if I am going to apply or I have applied using his employment offer letter?
Do I need to send any of my current or previous pay stubs from current and/or ex-employer?
Do I need my sponsor's financial documents?
what did you do after you got your approval? did you work for your sponsor or transferred to your current employer using AC21 rule? If you transferred then after how long after you got your approval?
Let's see If I apply by myself then is it OK to use my home address for all correspondence with USCIS?
Do USCIS inform sponsored about this all I-485 process at all or not?

Please understand that you need to have a sponsor to be able to apply I-485. If your ex-employer is not willing to sponsor you then you should try to start a new application with your current employer. You will be able to port your priority-date unless your ex-employer has revoked your I-140. To answer your questions...

You would need a current dated Employment Offer Letter which you cannot produce without your ex-employer's consent.
No, you don't need paystubs .
No, you don't need employer's financial statements.
I changed my employer, 1 year and 3 months after I applied. One can change employer after a minimum of 180 days from received-date of your I-485 application.
It's OK to use your home address.
USCIS normally does not communicate with the employer but it's possible that they may contact for employment verification purposes.
