Default Treasurer's Check - VOID AFTER 90 DAYS

Treasurer's check for the AOS was issued on June 14th. My application reached USCIS on July 5th.

I read Pappu mentioning in one of the threads that it might take USICS 60-90 days to issue the receipt notice.
My check will be VOID on Sep 13th(USCIS has to deposit the check at least a day or two earlier) which means if checks are not deposited by USCIS within next one month it will be void.

What should I do in such situation. Core Team, other Members I would appreciate if you can provide some info. on it.

Greg's Response (ILW.ORG) - 08/15/2007 1 PM

"I've not heard of anyone ever having a problem because the check was held too long before cashing"

It is URGENT because such cases have a window of opportunity to submit new I 485 application by 15-16th of Aug(May be without Medical Exam.).

I am not sure if next USCIS FAQ will be realised by Aug 15th?

I thought of this potential issue yesterday, after reading some posts(60-90 days for receipt). I will contact my lawyer tomorrow.

FrankZulu,
I think many applicants are in such situation and USCIS should come up with reasonable answer for this peculiar situation in next FAQ.
I don't know much about this type of cheque, but can you call the bank that issued this cheque to find out if there is a way to extend the 90 day deadline to something like 180 days?
Is it possible to renew it? I hope that such a window should be available and also understand that this is not which is very comon.

There are two possibilities:

1) USCIS does not care for the dates and just deposits the check.

2) USCIS looks at the date and rejects the application.(check has the issued date and "VOID AFTER 90 DAYS" clearly mentioned in front)

I can handle the 1st possibility by requesting the bank if they can extent the period but what if 2nd occurs?

USCIS will come up with an FAQ(say friday Aug 17th) but I am not sure if this issue will be addressed or not. And if not it might be too late to catch the last bus on Aug 15-16th.

Default Treasurer's check also called as cashier's check

A cashier’s check is a check issued by the bank on its own account after you give the money to the bank. Cashier’s checks are typically used for large transactions between private parties don’t want to risk carrying cash or when the recipient wants a check that cannot be returned for non-sufficient funds (NSF).

I'm just curious. Why would you use cashier's check? Is there any advantage? Opening checking account takes 10 minutes and they give you few checks right away.

Anyway, if you track late June filers you will see that they cash checks usually in 1.5 month. Even if sending the receipt will be delayed more, first thing they do is cashing the check. Moreover, they will stop receiving applications after Aug 17, so the issuance of receipts even might slightly speedup.

Lawyer asked for Cashier's check or money order so submitted one.

Normally lawyers prefer such checks as the amount is guaranteed when deposited by recipient. Personal check can be returned if insufficient balance in the account

Lawyer might have never thought of such a scenario otherwise he would have asked for money order & strictly money order (does not expire)

Janak,

You are right lawyer should have adviced as they charge hefty fees for the same.

But my request to all who have insight in such situations is, how to come out of this mess?

Should I refile file I-485? As I have 3 more days to do so.

Actually, I don't quite understand the situation. As far as I remember, when I was purchasing a cashier's check, I give the money (cash!) to the bank and they give me a check in return. So, the check is cash. Then, if this check expires, where is my money? They can't call me and ask me to take back the cash since there is no address/name associated with check, so they just think this money vanishes after 90 days? That sounds like robbing...
