RFE on I-485 while Porting EB3 to EB2
 
Hi All,
I was working as a software systems
engineer position in company A, applied I140 with second preference. It got
approved when i moved to another company B, worked as a programmer analyst and
applied 485 in third preference. Now I am working with company C(with decent salary higher than company A and B) with EAD,
applied AC21 too I came to know that this RFE is from AC21 and not the one I poster earlier.

Recently we got RFE regarding AC21 porting.

It is noted that
the salary quoted by Company C appears to be more in line with Software systems
engineer position from your second preference I140 from company A, although the
job description appears to be more in line with programmer analyst position
from the third preference I140 from company B.
Please submit a new employment letter from Company C
clarifying your job description, as it must be same or similiar to Software Systems engineer, if you want to use EB2.


Please respond with the format or suggestions to post new employment letter.
I will appreciate if anyone can help me in this regard.

ok. What did your attorney say ? BTW- when did you apply for porting ? Is it TSC ?

If you are worried, there is not much to worry, i hope you already know about it.

Generally whenever they see applicant moved between different companies they ask for EVL(emp verf letter), if this is the only thing they asked in RFE then it is nothing to do with porting, a standard RFE i have been hearing from year 2002 atleast.

This also means you are almost close to getting your GC and all other hurdles are almost over.

Keep your labor ad at hand and try to word the EVL in similar or enhanced skillset to show the job you taken is similar or same as the one your labor were approved and also try to emphasize the pay, expertise within same guidelines.

do you have a sample letter for EVL from present company that job description should be similar or same to the from comapny A job...

How did your attorney request for portability? Did he file a new I 140?
