Default How to find out if employer has revoked I140?

I understand that revoking the I140 after 180 days of filing I485 will trigger a RFE.

Is there a way to find out if and when the employer revokes I140?

Possibly, when USCIS takes up your I-485 they will look at the revolked I-140 to determine if it was approvable. If so, you might never know about it. Otherwise, they would perhaps ask you to find another employer willing to file an I-140 for you (for same/similar job as in LC, or with a new LC).

Hi Guys,

My I140 was approved in June using PP. I received approval but online still shows received and pending.

If employed revoke i140 then do u c status revoked or i485 get denied and then u know abt it.

Default My employer revoked my I140

My company attorneys filed my I140 under EB3 by mistake and was approved. They refiled with copy of labor under EB2 which was also approved. They revoked the EB3 I140 sometime in june but the status online still says approved...

Given the speed at which things are moving, it could probably take a few months before CIS actually cancel it.

I will look at the Sudden movement of LUD's on the Approved I-140 petition to raise a red flag. There might be a chance of Message saying petition had been revoked (Guessing).

Earlier, employers do revoke the I-140, so they can use the Labor for substitution for someone, Now that the Labor substitution is revoked and also the Labor is only valid (I guess 45 days, have to check), they is nothing in advantage for the employer to revoke the I-140 which is already approved, as you might end up joining this employer again. But again, with big companies, they do have a company policy/process for every little thing, and if they decide to revoke the I-140, they can. Also after 180 days from the time you filed, I-485, the AC21 regulation protects you.

How to find, if the I-140 was revoked, have no clue. Had not though about that. May be we need to consult an attorney with regards to this and also contact USCIS officials to get clarified on this issue, may be AILA can request details on how these kind of cases will be processed.

One of my previous employers revoked my H1 after I left the company. It's been close to 2 years now but the online status still says "Approval notice sent". I don't think it's a good idea to rely on the online status to find out if an application is revoked.

Can someone provide any inputs on this? I have my 140 approved last year in April 2007. I got a recent LUD on my 140. Any ideas what could that be for? Can my employer revoke my 140? Please advise. Thanks.
