Default Soft LUD's on all receipts after using AC21, H1B transfer

I have noticed soft LUD's on all receipts including I140, H1B with all other receipts (485, EAD and AP) for my self and my spouse after using AC21 with H1B transfer.

Not received FP yet and did not call Service center for it.

Any clues? or any experienced the same.

Nice to know that you started the process. Did you send the job transfer letter to USCIS along with H1B transfer or you just did H1b transfer (with plan to send the letter later).

In a way its nice that USCIS is tracking all applications together (H1B transfer, I140, I485 for a candidate). It atleast gives the confidence that they are tracking all together and may not get any RFEs to give them copy of I140 or such.

Please share any updates.

I had the same soft LUD on all my cases after AC21 letter was filed. No FP yet.

Default AC21 and H1 Transfer?

Hi Shana04,

Did you invoke AC21 with H1 transfer? I mean did you transfer your H1B to a different company which is not your GC sponsoring company? If so give me more details..

Question:
Am working for a GC sponsoring company and applied for 485 and received EAD, AP etc... Am not willing to move to EAD..can i change the company with a H1B transfer and invoking AC21? Pls give details..

H1B transfer was regular transfer but my new employer used the same job code as specified in labor.

My attorney, then send the AC21 with new employer offer letter to uscis.

I have responded the same to "kishdam "

I was in the same situation as yours.

Just file H1B with different company but with same job title and jobe code.

Then ask your attorney to send AC21, it is just a letter with new offer letter.

Do you really have to notify USCIS about you are changing employer as my lawyer told me its not required and this is one of the best lawyer, i did my H1 B trasfered before even my I 485 application may be thats why.

Would it be a problem for me if i transfered my H1 B even before i apply for I 485, as my lawyers explaination to that was as I 485 is for Future Employment and has nothing to do with the current employment.

Please do advice on this.

Default Hello Freinds

I will like to ask your brain if this could be a problem as i did my H1 B Transfer twice before appling for my I 485 and everything went sucessful my GC sponsering Company is not in good terms they might have even revoke my I 140.

Is there any way to find out if my I 140 was revoked.

I applied my I 485 and EAD in July last year my H 1 B was transfered in March Last year i got my EAD's and Finger printing is also done.

But my PD is Dec 2001 so i have already crossed 180 Days and now have the right to use AC21, do i have to file any particular letter for this.

Can you guys please advice i will really appriciate your help.

I TRansfered my H1 B Visa first time in the August 2006 from Company A (GC Sponsering Company) to Company B.

Everything went good.

Last year in March i did transfered my H 1 B to Compnay C from Compnay B

and i July last year i applied for my I 485, and got my EAD in Sep 2007.

Now the total 180 days have been passed am i eligible for AC21 and if yes then what are the formalities to get AC21.

As you said I 485 filed + 180 days. So you are out of danger.

1. You can check if your I 140 was revoked using your LIN number for I 140 if you have one
2. To safely use AC21, find out your job title, job description and salary mentioned while filing your I 485
3. Your I 140 should be approved
4. then you can use AC21 with H1B transfer or with your EAD. I would advice to use AC21
5. your sponsoring H1B employer should mention the same job title and job duties as it is mentioned in EVL (employment letter) while filing your 485
6. If you have hired an attorney he would then send a AC21 letter(just a formal letter) with your new offer letter, with your 485 receipt number and 140 number (if you have).

That should take care about your AC21.
