AC21 Portability after 180 days of 485 filing AC21 Portability after 180 days of 485 filing. Changing employers without affecting green card process.

Default EAD - when do you plan to renew

I have been noticing a lot of people moving changing jobs using EAD. Especially a lot of June and July 2007 filers.

The time to renew EAD is approaching and I am sure there is going to be a surge in EAD renewals.

There was also a recent communication from USCIS that one must not apply for renewal prior to 120 days of their EAD expiry date.

In past has anyone been in a situation where they are not able to renew EAD in time and how you handled it?

Do you plan to apply for EAD exactly in the 120 day range to make best use of time? What if EAD renewal gets severly backlogged?

I think this is something we must all concentrate on and try to get some answers from USCIS on this as it will help planning.

It is really a good pointer you have brought into discussion. My lawyer advised
me a " 100 day" rule. "On 100th day before final date we will send the renewal application to USCIS".

Why the "100 day" rule? I thought the magic number is either 120 or 90. Thanks.

Only requirement is: it should reach between 90-120 days. not on 89th day and before and not on 121st day and after so I guess, my lawyer picked up a sweet figure "100".

I am in this situation - using EAD and employer's lawyer is simply suggesting to send it around 90days before the expiry - I didnt really discuss in detail but he sort of mentioned casually that most EAD's get approved in 90 days and if its still pending for more than 90days we can go to local office and get an interim EAD immediately.

But as everyone else before said - its a important point to consider and if someone who got interim EAD earlier - would really appreciate the procedure to do that (i.e. take InfoPass appointment and request for interim EAD - what documents we need to take and what to explain to IO and most importantly is it straight forward if we get interim EAD immediately on the same day).

Around July-December 2007 IOs were refusing to process interim EADs. I do not know what is teh situation now but if somebody might have to deal for it in recent past than it would be nice to know about his/her experience.

Its news to me.. Anyone heard of this before??
My lawyer plans to submit renewal around 90 days and said if it gets severely backlogged... I can still work upto 120 days with receipt...

My hubby called up USCIS asking the same question..and the woman said that he can work with the receipt till he gets the ead card...this is the first time i am hearing this that too from someone at USCIS!

ajju, smiledoc - can you refer to valid links on a website or a USCIS guideline?
I have heard of stories where people had isues renewing their EAD in time.

Can someone share their experiences?
