One of my friend whose priority date is in 2006 also got RFE, but don't know the details yet. Waiting for physical RFE letter...

I am pretty sure lot of people's EADs will expire around the end of August or September. My EAD expires at the end of September. Should I send it in for renewal just wait to see what happens until the next month.

But here is the main content of the letter: Nothing much to worry! Relax.

1. Current employment letter:a) On Company letterhead - current position, duties, title, dates, salary and wage signed by the authorized person.
b) If changed employer, submit evidence to show you remain eligible to adjust through visa portability under section 204(j) of INA. Its basically same above letter supporting original I-140 position.
2. Maintenance of Status: Proof of continuous employment. Evidence may include
a) EADs, I-688 or I-766
b) I-797 approval notices
c) Copies of I-94 Arrival/Departure records.
3. Current Medical I-693

Rest is general information.

Relax, find proper attorney, make clean professional reply and calm down.

Ok, I can get an employment letter from the same company that actually hired me. I worked for them until 2011 but then I quit to help my wife with her own business. I didn't file any ac21. I can get a letter from them that they are willing to hire me at my previous wage after I get my green card or whenever I want. Do you think that will suffice?

I can also ask them to give me pay stubs since last few months showing I am still working for them with the same duties etc.

My priority date is Nov9 2004-EB3-India. Staying in this county since 2000. Since now there is some light at the end of tunnel want to ensure I am ready with the documents once situation comes up.
Here is my question:
A) I changed employer on Jan21 2008 on EAD and the position was same as was filed for my labor.
B)In May 2009(-till date) I changed employer.My title and job responsibilities changed. I am talking to employer to give me EVL which matches my original job requirement.
Do we know how much % the existing job should match original one?
There is around 50K diffference(more) in my salary from the one in petition-Will this cause any issue?
Should i plan to go to original employer?If my present employer provides EVL and USCIS is not satisfied-at that point of time can i go back to my original employer?

Please share your thoughts since I am really in dilemma and not getting clear answer from lawyers.

From what i have gathered on the net, USCIS will be "rational" in their decision making and will look up several factors to make their decision on "same or similar"

1. Job Title is the least of their concerns as this may be different. (e.g. program Director and Project Manager may be similar roles)
2. Description of Job duties needs to be similar roles and responsibilities and within the same Field. (e.g. IT to IT).
3. Salary needs to be within range. I would consider 50K different to be out of range and a red flag if your roles and responsibilities are not very similar (Yes i know its draconian laws that don\'t allow people to earn more but they consider this as being a truly big change in jobs.
