Default Entry using AP after H1 Visa rejection?

Is there any one who entered US successfully using AP after their H1 visa got rejected.
I am planning to visit India in Dec. I have approved AP. My H1 visa got expired on Sep 30. I am still in dilemma whether to go for visa stamping or not.
Please share your experiences.

Default No problem with AP

The process is very smooth, I was worried the same as you are know, you just need a valid passport and the AP also I put an extra photocopy of the AP in my passport when I presented it. They send you to a special office they check your doc's in a computer and in 15 minutes you are done, if you have a connecting flight is wise you have a connection window of at least 3 hrs just in case in this season due to the high volume of travellers.

Default Go for H1B Stamping

The chances of H1B is getting rejected by Consulate is very rare if you are currently working in the same company in US and have all proper documents required by consulate. The only problem you can face is the DELAY.

I heard from more than 4 good immigration lawers say that AP is good if you do not want to go for stamping either you wish not to get H1B or because of unusual delays in visa stamping.

No one said, you can use AP if your H1B is rejected. As of now,their systems are connected very well and when there is a rejection, your passport number may not work at Port of Entry. Do you think it will work? You may have to answer a lot of questions.

So either you take the route of not going for stamping and start using AP, no problems. OR go for stamping.

This is what i got from My attroney when we enter using APp and would like to work on H1B.


I am planning to go to India in December. I got
Advance Parole and EAD recently. My H1b is vaild till
2009 and i don't have valid visa stamped in my
passport.


Q:If i use Advance parole at port of entry, will it
possible to work on H1B or do i need to use EAD?.

Attorney: If you are admitted with Advance parole, you may continue to work
without an EAD card until the validity date of the H-1B I-94 which you
held before leaving the U.S.

Q:If it possible to work on H1B, when should i apply my H1B extension?.

Attorney: Before your previous I-94 or your parole expires, whichever occurs
first.

Q:I heard at Port of entry i may get
i-94 and will be valid one year. So do i need to apply
my H1B extension after one year or can i wait till
2009?

Attorney: The most prudent course would be to apply for an extension before
your previous I-94 or your parole expires, whichever occurs first.
