If your wife enters using AP, this should not be an issue.

If she wants to use H4 instead of AP, then she may need to have a valid VISA stamp.

Please advice her to use AP instead of H4.

WOW!! What was your Port of entry? I think popular immigrant POE's like Newark, JFK, SFO etc will have better seasoned officers than some other places.

Default Travel Experience with AP

Went to India on 11/19/2007
Returned back on 12/31/2007
Total Days - 42 days

Port of Entry - SFO (San Francisco)

- Went Thru "US Citizens and Immigrants line"
Officer looked thru AP, Passport and asked for I-94 and in couple of minutes sent us for Secondary Inspection. Sat there for about 10 mins, officer called stamped our Passport, AP and I-94. Didn't ask if we have other AP copies. Just stamped the one which we gave. No questions asked. Cool Experience.

Default Travel Experience with AP

Came from India on 30th Dec using AP. My H1 VISA was expired in 2001.
The guy in the counter asked couple of questions like "employer name" and asked me to go to the secondary verification. They took my 2 AP sheets , I94form and passport. After 5 minutes my name was called. One AP sheet was stamped and returned. He said next time i will be given a copy of it. The "paroled until" date on AP and I94 were 29-Dec-2008 ( 1 year validity) even though the original validity date printed on the AP was Jul-2008.
Not sure whether i can use this AP until Dec-2008.

Thanks nlssubbu for all of your input.

I have been reading various opinions about sponsoring H4 to wife after using AP. In one of your threads you have mentioned that one of your friends wife got H4 after your friend used AP. I would like to know more details about this.

1) Is this common practice. I mean, all consulate officers is aware that this is doable?

2) Does your friend has to reinstate his H1 status by filing H1 extension before he sponsorted H4 to his wife?

If you don't mind, please provide us your email. I would like to talk to you.

I travelled to India in dec with expired H1 visa and came back using AP. At entry (Wash Dulles Int, IAD) the Officer didnt ask me any supporting document for my AP. Just passport and AP, did some 5 min check in the office room and came back asked me if i was carrying any food stuff and that is all.
I got my AP in the last week of Nov,
485 applied in aug '07

Default Using AP when traveling back from Canada by road

Hi, Has anyone used AP when traveling back from Canada by road.

I have to go to Toronto and am planning to drive. Since my stamped H1 is expired I would like to use AP to come back to US.

Has anyone in this form done this before? Appreciate any feedback

OK, my question is if you go to Canada for less than 30 days and play by all the other rules of automatic Visa revalidation, do you HAVE TO use AP when you return. Can't you just use automatic visa revalidation at the POE?
I think this is a better option than using AP unless there's a law that says you can't do this once you file 485 which I have not heard of. Other input is appreciated.

Hello,
I came to US during 1991 on a tourist visa.
I changed my status from a tourist visa to student F1 visa in the US.
I changed my status from student F1 visa to H1 visa in the US.
I recently renewed my H1 for another 3 years.
I recently received my AP and EAD documents.

I have to go to China for a month and come back to US.
Do you forsee any re-entry issues with my kind of visa record?

Default Q: Travel on AP and photocopy of I-485 receipt

Hi All,

I will be travelling on AP from JFK to Delhi and coming back in March. My I140 was already approved. 485 was filed in June,2007. I already have EAD and my fingerprint have been done. My attorney says that I even dont need photocopy of the 485 receipt to travel with AP. After my several request He will send the photocopy but not the original copy. Should I be fine. Do anybody have any problem travelling with AP and photocopy of the I485 receipt.
Please response ASAP.

I entered US yesterday using my AP. I landed in LAX and it took 3.5 hours to get through immigration. That was bad

Everything what you have done is Legal according to the Posting. Please consult a Qualified Immigration Attorney to make sure you have sufficient Documentation while coming back from China that includes AP, I-485 Receipt just in case.Again Pls. consult your Attorney.
