Default AP experience on Feb.11.08 at Washington, D.C

Hi Guys,

I would like to share my AP experience on Feb.11.08 at Washington, D.C.

Visa status: H1B Visa expired.
Port of departure: Hyderabad, Andhra pradesh
Port of entry: Washington, D.C

I went to non-citizen/non-resident lane and gave my AP (2 originals), Passport, I-94 and customs form to the Immigration Officer. He sent me to the secondary inspection.

The Immigration Officer at the secondary inspection took the documents (AP-2 originals,Passport, I-94 and customs form) and asked to sit to be called. After 30 minutes a woman Immigration officer called and asked only one question that Who is sponsoring your greencard? I told her my company and mentioned my company name. She stamped my I94 and one AP and returned both original APs. She did not take any AP.

Default Big Mistake

She forgot to take your AP, you should send the AP to the INS Address Mentioned in at Murthy.com
If they dont take it, you should insist them to take it. If they forgot to take it, you shoul send the AP immidiatly, its very very important. If you want to maintain legale status

Please read Murthy.Com for info, Murthy suggests that its very important that your AP's should be returned to INS. I am not sure about the legale implications, but this effects your I-485 processing
Please man return the AP's to INS.

I seriously doubt if you have to return the AP to the officer. I traveled 3 times to India with my family ( all in AP ) and not even once the officer took mine away. it was stamped and given back to me just like kmkanth narrated.

I thiink you are confusing I-94 with AP. Can you sedn the link where Murthy discusses this issue.

The immigration officer is supposed to retain one of the copies of the AP and return the second one to you.

Stop scaring people. In all of the cases where people used AP, the CBP officer did not take AP document. They stamped it and gave the original back. They have that information in their system that you have used AP to re-enter the country. What makes you think that if they don't take AP it will impact 485? We are not in paper based world, its all electonic. Dude, wakeup and provide some evidence for your comments.

If what you said is correct, 100's of people's 485's should come into trouble. Its understandable if one CBP officer makes the mistake of not retaining it, almost in all POEs they are giving it back. AP is not a new thing, so i am sure CBP officers know what they are doing.

Default Passport stamped as parolee at POE but not AP

I used AP at JFK in Jan 08. The officer stamped my passport as paroled untill Jan 09 but did not stamp my AP and gave it back to me. When asked why he did not stamp my AP, he said stamp on AP is not required. Any body in same boat?

Guys hold on, I have confused I-94 with AP, I am really really Sorry.

I-94 should be returned to the office, I do not know about AP.

Default no issues

OK, the general practice is that if a person has more than 1 original APs with him/her, the officer should keep one and stamp the second one. But even if the office does not take one, a person entering on AP is NOT at fault. As long as one receives a stamp and a new I94 at the time of entry, one should be ok. It is not your fault that the officer did not take one of your APs for any reason. It is their foult and not yours and should not have any impact on your I485.
