Default Got engaged - Now PD gets current

hi,

i have been told that the only option of having spouse on your green card application is to get married before 485 approval comes through. I recently got engaged and my PD is current in sept bulletin.

Starting 1st sept there is a realistic possibility that 485 approval comes through. Is going to india, getting married by end of august my only option. Please advise.

You better hurry if your priority date is current. You need to give this some priority. As USCIS seems to approving 2006 cases more than any other year, you have to hurry. One your GC is approved, you will have hard time bringing your spouse as a dependent.

If your prospective wife is already in USA, you can go to a court and get legally married within one day. If she is in India, then still plan for a quick trip and get a legal marriage cerificate. You can get the traditional wedding dne later. I know quite a number of people who did that in July last year.

thank you all for your response and suggestions. is it possible for spouse to stay in home country or would she need to enter and stay in US on H4 to be eligible for AOS or can she enter US, stay until application and docs are sent to USCIS and then go back to home country.

If my approval comes while spouse is in home country, would that be considered a case for 'Follow-to-join'.
