Default Appliying for FAFSA while on H4 but having EAD

My Wife wanted to join a school for some course. We decided to apply for FAFSA to pay for School fees. I am not sure whether she is eligible to apply for FAFSA or not.

Can some Guru shed some lights on this?

By the way, she is on H4 but we have our EAD. She has not started using her EAD as of yet.

Default She should be eligible if she is pending AOS status

I think as long as she is pending AOS status, she should be fine. But I don't think H4 will be eligible for FAFSA. But if you filed tax jointly and your income is good then she will not get FAFSA funding, HOWEVER, she will get FAFSA loan (subsidized and unsubsidized). Subsidized loan is loan you don't pay interest until you graduate.

During FAFSA application, you need to submit I-94 and it will verify your status I believe. I have seen people getting FAFSA approval for pending AOS without any problem.

I hope this helps. You can get more information from the college she is applying for.

When last time we entered in USA in Feb 2009, We used our H1/H4 visa to enter even if we had our AP in hand. So Her I-94 will show H4 stamping.

Will that make her ineligible for Applying for FAFSA?

Hi,
I am in your stage. I am in AOS stage with EAD. I applied for FAFSA and I do qualify under 'Qualified Non-Citizen.' But, the school financial aid office was not aware of my situation and it took more than a month for me to educate and make them aware of this.

The FAO people only know about GC or Citizen. You will have to talk to the
School's International Office to evaluate your situation and ask them to talk to your FAO to explain about your immigration status.

I talked to the FAO and they seem to understand my situation. I just want to see if my wife qulifies as 'Qualified Non-Citizen' because she has not used her EAD as of yet and neither I have used my EAD or AP.

Hi desimass77. How do you convince the school that you are qualified?

My wife has a similar situation. We tried to convince school that we are qualified under "parolee" category. However, my wife's I-94 expires (she entered US using AP last June). Her school uses this reason to reject again. Now, we decide to re-enter US again to get a fresh I-94.

Her school officials say that they are going to query USCIS database once my wife gets a new I94 stamp. It is something called G-845 form.

Just curious, did you school query USCIS database on your case? Or your school just think yo are qualified?

I think the "parolee" category is really ambiguous, since it requires student to enter US with parole for at least one year. On the other hand, it wants I-94 unexpired. AP can hardly fit into this category, as if we entered US, the valid length is usually less than 1 year, unless we re-enter US on the exact same date when the AP was issued.

Please, if anybody successfully convinced school on FAFSA, please share your experience here!

Yes, my school did query with USCIS and got the confirmation that I am at AOS stage. I got AP valied for one year, but I did talk to the school stating that since I am within USA I will not get I-94 as I-94 is given to people who are entering from outside. As my new AP is issued by USCIS it is a valied document.

My FAO communicated with their International Students office who handles immigration issues to confirm this and I got my Loan approved.

desimass77, thanks a lot for your response! Congratulations on your loan approval.

My wife's school insists that AP document from USCIS is not a valid document unless it has been stamped by customs, which forces us to re-enter US

I will argue with school again. Thanks a lot for your information.

As per the FAFSA application to be eligible-non citizen one should have a valid I-94 with a valid parole stamp at the time of applying.
My daughter is in same situation & I have applied for her AP. After she receives it I am planning to go to CANADA with her. she will re enter on her AP.

Default In-state Vs. Out-of-state Student

Hi All,

I'm in AOS/EAD/AP situation since 2007 and worried about college education/financing for my son.

We are in Delaware and yesterday I met Admission Office and Financial Aid Office of University of Delaware (UD). Both offices recognized that my son should be eligible to apply for FAFSA based on 'parolee' stamp on I-94. But that would not be enough to consider my son for in-state student. Admission Office would consider only person with GC or Citizen as in-state student. As per them, FAFSA Aid and admission to UD are two separate matters. In other words, even if FAFSA approves application on the basis of 'eligible non-citizen', UD will not consider my son as in-state student until he gets GC. UD is private college.

Have any of you been to this type of situation? is there any way out ? Is there any other state/university who honor FAFSA recognition as an eligibility to consider in-state student?

Please share your thoughts. It would be great if some of you can share your email/contact number so that I can contact directly to discuss more about this.

Hi,

Can anyone who has gone through the process clarify how to apply for FAFSA on AOS? I have seen different threads online regarding this and am not sure how to proceed.

We applied for AOS in 2007 and are still waiting. My son has his EAD and will be applying for his SSN. We live in CA. I called the FAFSA office yesterday and they were not clear about this. Will he be considered as an eligible non-citizen? Will they ask for proof? If so, what should we provide? I would appreciate any information regarding this.

Thanks for your help.
