Default Did not renew EAD

Hi,

Here is brief background about me:

1. I-140 Approved, EB2 Category

2. I-485 pending for more than 2 years.

3. H1b petition approved until Sep 2012.

4. With the same company that filed my GC.

Here is the question:

I had applied for EAD for me and my wife (wife is on H4). H1b petition and H4 were both valid when applied for EAD.

Never (both me and my wife) used the EAD.

Reason to apply for EAD: My wife could work.

My H1b and H4 extension came in the month of Oct-09.

I was supposed to renew EAD in the month of Nov-09, but did not renew it because I have the H1b extension (6 years will be completed in the year 2011) until Sep 2012.

My wife never got a job and she is currently undergoing self-training (for about 3-4 months) and then there is a chance that she may get a job.

What happens if I renew the EAD in say month of April 2010?

There is no regulation or policy that prescribes when you should renew your EAD. So, yes you may renew it in the month of April 2010 or not. However, be aware that your spouse cannot work until the EAD application is approved and the card in hand.
