Default National Interest Waiver

My friends,

I have an approved I-40 from my previous employer (EB-3 category) with a pending I-485; I would like to switch over to EB-1 (National Interest Waiver) .

I was wondering if I have to file the I-40 again with this new employer.


Please advise me accordingly .

National Interest Waiver is for EB-2 when the applicant doesn't have a job offer that meets the EB-2 requirements and wants to skip the labor certification process.

You need to file another I-140 if you want to change your application to EB2 or EB1.
