Default Should I upgrade I-140 to premium as PD became current?

I have I-140 pending (applied in regular processing). Now as my PD became current, I am planning to apply I-485/EAD/AP with I-140 receipt notice and it is okay as per my attorney.

Is there any special benefit to upgrade I-140 to premium processing in my case? Any suggestions will be appreciated. Thank you in advance!

Default I-140 Premium Processing

I was thinking of doing the same thing. This is the response I received from my attorney.

We strongly recommend obtaining an I-140 approval before we file the I-485 case, as the USCIS has a bad history of rejecting I-485 cases if the I-140 is not first approved. If you are interested in upgrading your I-140 to Premium Processing, this would help speed the I-140 processing, which would then enable us to file the I-485 sooner.

Hello there,

I am in smae situation; I-140 is pending as I can not request for premium because I had request for re-cap my old PD using previously approved 140 (lay of from previos employer). I was not sure if we can apply for I-485 when I-140 is pending? I am hoping for get an approval as I had receipt date of Sep 19 2006.

Please let me know if you get an update from your attorney. I will also let you know if I have any new to share with you.

1) To get i140 approved via premium processing
2) File 485 and let I140 take its own time.

Any light on this area will be really helpful.

Default Read somewhere in another thread ...

that in today's bulletin, there is USCIS commentary that dates will retrogress for China and India in Sep, but more severely in early FY 2008 , which is Oct 2007. So, upgrade to Premium and be ready to file I-485 before Sep 2007.

I-140 approval is a big benefit

AC-21 is lot less risky with I-140 approved and with so many application filed Regular I-140 will be a lot more time..

Go for PP without thinking. It is worth.

I was told by my some experience people that bumping to premium process makes the application to goto supervisors desk and which may result in extra RFES...

If your PD is anywhere after 2003 , I dont think it makes a difference .

My PD is january 2007, so i think will go for PP.... is it possible to go ahead and file 485 and then get PP for 140.

Question Pending 140, wife on J1

Hi Guys
I have 2 queries:
1. My I-140 is pending with the USCIS filed in march 2007. Will it still be possible for me to file for the 485.
2.When my 140 was filed my wife was on H-4 visa. Now she is on the physician's J1 visa with the waiver requirement.Will it be possible for me to apply for AOS for her too or will that need to be done separately once she is done with her waiver requirement?If so then will her application be treated as dependant EB(i.e. on me) or as Family based?
Will really appreciete if someone can answer the query for me especially an attorney if possible.
