Default I140 RFE- experince

I got the RFE on my Eb2 I-140, Saying that I don't have 5 years post-baccalaureate experince on the job offered.

My Details.:
I received Btech Degree in April 2002. I Joined current company XYZ in Jan 2007 and with same company who filed by GC on EB2. I showed the experince starting from July 2001. which calculates as 5.3 months before I joined my current comany XYZ. Looks from the FRE that they are not consider the experience while I'm doing Btech.

One more thing I want to share is that I have just applyied my 7th year H1 extension.

Could someone please let me know what are my options.

this has been clarified by many ppl, if you are EB2 you should have atleast 5 yrs after graduation and before joining your current GC Sponsor. anyway consult a good attorney

This guy posted the same questions few days ago with the same spelling mistakes etc. I don't this guy wants any answers but to stir things up.please don't respond.

I didn't get the correct answer for my question. That is the reason why I posted again, apologies for posting again. People post here to get good guidance not for just time pass.

1). could anyone please suggest what options I have now with my current experience.
2). I have distance MBA, Can I show my Distance MBA at this stage to qualify for EB2. I didnít show by MBA in labor or I140, as I was thinking that it may not be required as this is Distance MBA.. Can I produce now?

there are too many questions dude. is your distance MBA before joining current company ? its all depends on job requirement not yours though.

Yes, I have done my Distance MBA in 2003 -2004, this is while I'm working.
In the job requirement they mentioned master degree or bachelor with 5years exp.

But when we filed in the labor or I140 it didn't say any masters is required. Just mentioned that at least 5 years of exp with Btech.

You need to meet the following 2 eligibility criterion to qualify for EB2.

1) The position/job should require a resource with EB2 qualifications (Under grad + 5 yrs or Grad + 2/3 yrs as defined by the ad. posted by the employer)
2) Your academic qualifications and experience should match the ad posted.

I'd think that in your case, ur academic qualifications + Exp. didn't match the ad., hence the RFE.

Does ur ad. contain MBA as one of academic qualifications for the job? In either case, ur lawyer is best source to provide the reliable answer.

If ur labor is cleared, you may get an year extension.
