Labor approved, I140 Denied, H1B expiring in two months
It has been a frustrating day. I just received information that my I140 was denied stating "section 203.3.A.ii - Professionals category should have a bachelors degree"
I have a 3 year indian degree but have over 15 years of experience. my labor cenrtification had the job that required Associate degree or equivalent with 7 years of experience.
I am not sure why denied it. I have a meeting with our company lawyers on Monday but any input here would be greatly helpful.
I have two questions:
1. Should they file new I140 with the information they have requested, or ask them to review it with the additional information.
2. Since my H1B (6 years) is expiring in 2 months, will it get extended even through my I140 is denied at the moment?
