Exclamation URGENT Help Needed on I-94

I have my H1-B VISA Expiration date as SEP2014. My Orginal I-94 Expiry date is Oct'2014 when I entered US for first time. But last time when I went for a vacation and came back to US at march 2013, in port of Entry my admit until date(I-94) is sealed by officer as 01FEB2014. That time my passport expiry date was 01FEB2014, so i thought that might be reason he is sealing the I-94 as 01FEB2014.

Now I have got my new Passport and I travelled out of country for a vacation. So If i have to travel back to US, Do I still need to be in before 01FEB2014 or can I come after that as I have my actual VISA Expiration date as SEP2014.

In my opinion; as long as you have valid visa stamped in your old passport showing the date as SEPT 2014 you will be allowed to enter after Feb 1 2014. Please make sure you carry the old passport as well on you.

I have traveled with a new passport and old passport that contained the stamped visa. So, you should be fine, in my opinion.

Same here. I entered couple of years back with old and new passports. The visa was in old passport. There were no issues at PoE.

If you are stuck without being able to file I-485 due to “priority date being not current", email your
a) IV username
b) contact (ph#, email),
c) priority date and
d)location to i485.mailing.list@gmail.com .

Until Congress enacts legislation to eliminate backlogs, people who cannot file I485 will always be in limbo and at the mercy of endless H1B visa extensions and visa stamps. Join us and be a part of future IV initiatives to push USCIS to allow I485 filing without current PD.
