Default Company Acquisition with pending 140 and 485

Hello Guys.

I have just known that my company will be acquired by another begining next month.
I have filed my 140 (Regular processing in Feb 07) and a con current filing of 485 in July 07.
PD = 2006

Do I have to start my GC process again?


Please respond with your inputs.

You should be OK since your case is "successor in interest" type. Your lawyer might need to update your new company name during your next H1B renewal. Check with your lawyer and see if the I-140 needs be updated with the new company's name. You may want to do a search on the sites since this has been discussed quite a few times.

IMHO, if your employer's TAX ID changes, they will be required to file a new I-140 for you in the name of the employer with the new TAX ID.

I belive the way a H1 is treated is different from how the GC process is. My answer above is related to the GC part. Re: the H1 part, I'm unsure, but I believe in some situations, you're required (ie employer) to file an amendment. You should check your situation with a lawyer.

I think you only need to re-file your I-140 for the Successor in Interest. You can then interfile your I-485 with that new I-140. However, for complete peace of mind, pls consult an immigration attorney.

The moment I saw this thread, I knew it must be yours. My suggestion for inter-filling - talk to Rajiv khanna he handles this kind of cases a lot.

Whats needs to be done if I-140 is approved and 485 is pending since less than 6 months??
