Priority dates transfers and Post 140-approval options Discussion related to transferring priority date of old green card file to a new file after 140 approval.

I am recipt of my physical notice today at my Companys office

To my surprise

It says

The case is transferred to NVC which handles cases for consular processing

Can some one tell me

can USCIS transferr the case intentionally for consular processing even if we file for AOS

I am very sure we did not file for Consula processing

Experts pls help

If you filed for 485 /AOS then USCIS will request the petition to be sent back to the Service Center where u file your 485.
To convert from CP to AOS is simple just file 485.
To convert from AOS to CP you have file I 824 where in USCIS sents the approved petition to NVC and notfies the Consulate regarding approval of immigrant petition.
Relax , Chill . If you applied for 485 USCIS will request DOS to sent back the approved petition it had shipped to NVC. Naturally this trasnfer of case from NVC to USCIS Service Center will take arond 120 days.Bottom Line is your 140 is approved. Please ask your attorney to check out how come they send for CP when AOS has been checked in application.
But i would not sweat too much on this.

There is nothing to worry. So relax and be happy that your 140 got approved. Even if its marked for CP as soon as you file 485 its processed for AOS.

My Cheques have been cashed finally for 485 (july 2 filed)

Will there be a delay in getting my Ead since the case has been transfered for consular processing
I guess it NVC takes 120 days to get the file back to USCIS

EAD and AP will be processed in the normal timeframe but to transfer your case from NVC to USCIS Service Center where you filed your 485 is around 120 days so your 485 processing will be delayed but not by a lot considering the retrogression.

Default Need help in understanding the I-140 status

Hi Guys,

I filed my EB3 I-140 to TSC in June 2006 and it is still pending (yes..really more than 450 days and counting...) Then in July 2007, I filed my AOS with NSC. Today, I got an email from CRIS stating that

Application Type: I140 , IMMIGRANT PETITION FOR ALIEN WORKER

Current Status: This case has been sent to another office for processing.

On September 4, 2007, we transferred this I140 IMMIGRANT PETITION FOR ALIEN WORKER to our LINCOLN, NE location for processing and sent you a notice explaining this action. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you.

It is transferred to NSC because my AOS is filed with NSC? Have any one had this status change in the past? After this, how long did it tak to get your I-140 approved?

I am just curious because can I feel happy that atleast some progress? As you know, I am waiting for my I-140 for more than a year...
