I-140 Pending..Can an applicant change the job after 6 mnths?
 
Hi Everyone,

Out of Curiosity, I would like to understand what will be the situation if the employer starts laying off people whose I-140 is pending but they have received EADs.

For example If the PD is of 2001 and I-140 Receipt Notice is of July -07. I know you must be surprised that its very near for the 485 approval but the catch is 140 pending.

I am personally in this situation :(. Some one suggested me not to travel outside the US if you loose the job and its not a problem if you leave the company after 6 months of I-140 Filing date. Gurus should shed some bright light here.

The situation is the 485 will be denied if the employer revokes the I140 or withdraws the petition.
You will have to start from scratch .
If you change your employer while I140 is pending, the employer has the right to revoke the I140 .The 180 days start from the day your AOS RD assuming your I140 has been approved already

Thanks So Much for the Quick Suggestion on this. I will wait and see what happens for next couple of months. If they lay me off I shall request them not to revoke my I-140.
