Can we file 2nd I140 by withdrawing the 1st
Hello everyone,

Can you file a 2nd I-140 with the USCIS if you withdraw your 1st pending i-140 for the same company and same position.

Please any suggestion in this matter would be greatly appreciated.

I have a similar case.
I have first I 140 appeal pending with a new I 140 in the system.
Talk to your lawyer.
You dont need to withdraw your first case.... USCIS will do it for you... whey they see two cases, they usually come back and ask your lawyer/company to continue with one..... (of your choice). But its complicated. give us more info.....
Also let us know your reason for doing this, so you can get a better answer....

Yes, the reason i was doing this is was because my LC hard copy got lost and my lawyer suggested that I pursue this path in my best interest. Now i also withdrew my Labor and refiled my labor which recently got apporved and I just got information that my I-140 which was pending at USCIS got officially canceled.

However i filed LC on the same portfolio as my fist one -- same company, same position that is what I have to do with my I-140 too. Is your case similar to mine. Please advise
