Question I-140 LUD Changed after 485 filed- What about yours?

One of my co-worker filed I-485 in July! ###

She had two I-140s approved.

One from current employer who filed her I-485. EB2 approved in June 2006.

She also had one earlier I-140 from previous employer. EB3 approved in 2003.

She requested her company attorney for PD transfer. Attorney was not in the mood and suggested not to go for PD transfer. Her 485 application reached USCIS (TSC) on July 28, 2007. She received EAD, 485 receipts and also her AP is approved and FP is done. Today she noticed LUD for both of her I-140s.???

The LUD for both I-140 is august 08, 2007. This is around 10 days after her 485 reached USCIS. However her notice date is late september. So my guess is, although her 485 reached USCIS in july end - it may not be still opened till september end. How come her I-140 LUD got updated in august???

WHAT COULD BE THE POSSIBLE REASONS for this LUD? Is there any one else whose I-140 LUD updated after filing 485 and years after I-140 got approved?

One more interesting fact: she has same A# on all of her I-140, 485 etc. Does this has something to do? In my case, I have different A# on 485 than what I had on I-140.

Most of the people had a soft touch on their approved I140's, this is nothing new, USCIS might have tried to link 140 to your 485.

I filed on 7/2, there was a soft touch LUD on 7/28 - most people reported the same around this time frame.

USCIS data entry personnel was able to locate her previous A# for your friend. In your case, some how they could not. Your latest A# is valid, it should be the same in your FP, if not get it corrected when you go for FP and call USCIS after a day or two and verify the updated info.

  • In the October 24, 2007 USCIS HQ Stakeholders Meeting, the USCIS gives the following answer:
    • Question: Should I be worried if I receive a different A-number after filing an application for adjustment of status on Form I-485?
      Response: No, a temporary receipt process was implemented for Employment Based I-485 applications filed between July 2, 2007, and August 17, 2007. The temporary receipt process allowed USCIS to receipt the high volume of I-485 applications filed during the summer in a faster and more efficient manner. New A numbers were assigned during the receipt process. At a future date the newly assigned A numbers will be reconciled with previous A-numbers that may exist for each applicant and the newly assigned A-number will be deleted. The temporary A number will also appear on the EAD card. This temporary receipt process also facilitated the receipting of I-765 applications for employment authorization and I-131 applications for advance parole.
