So now you have EB-2 India with PD 4/2004? Congratulations - that was smart. Unfortunately there are thousands like you who are porting from EB3 to EB2, except that they have PD in 2001 and 2002. EB-2 retrogresses to Jan 2002 in about a week's time. With an annual quota of about 3000 which includes dependents, I am guessing it will take 10 years before EB-2 gets to your PD.

That gives you plenty of time to think how to upgrade to EB-1 next.

Humdesi....whats your problem dude? Is there anything illegal or unethical in what I have done? I ported my own PD from one category to another....

If you are furstrated with anything in your life show it on your family members (though i don't recommend that)...but thats better than venting it on forums on complete strangers like me...

I posted the above one for people who has many questions about PD porting in the past....!!

Did you get a separate letter confirming your PD transfer? if anyone else got any such letter, let the forum know how much time it took.

Having 2 different A# numbers in your I485 applications is a cause of concern and causes further delay. Not sure about A# on I140.

Nothing wrong in what you have done. Everyone is just frustrated with the overall messy and illogical system and the inordinate wait times. Issues like Labor Subs. and EB category porting further inflame peoples frustration because just when they think they are close to the finish line, it makes them realize that the finish line was a mirage. After a few rides on this roller coaster, they get nauseated, and see points like this as part of the reason.

Can you tell us which service center this was? TSC has been somewhat better with this issue than the NSC.

Pappu - I did not get any letter. Actually my PD porting happend during approval of my 2nd I-140...so the PD shown on my Eb2 I-140 approval itself was a confirmation. (we sent a letter while applying the Eb2 I-140 that I already have an Eb3 140 approval and asked for PD transfer....I requested my attorney to send another letter when NSC neared the processing dates). If at 485 level you request for PD transfer (both 140s are already approved by then) i am not sure how one can get a confirmation about it.

Alterego - My I-140 application was processed at NSC. Actually NSC has a clear set of instructions for PD transfer requests...see the link below...

The link u provided only talks about PD porting within same category as in when one moves from one employer to another after 140 approval. it doesnt talk about PD across categories i.e older PD with EB3 to EB2

Sundar - I did have a xerox copy of the previous 140.

Rani77 - I gave that link only to show NSC instructions...but later Murthy gave another bulletin saying its a typo they mentioned "same employment category"....!

Default Question?

Posting this here since I dont have ability to open a new thread.

My Labor was filed with the state labor dept on Mar 30th 2004. However the I-140 approval notice has the following: Date of Acceptance for Processing: April 04, 2004

Whats my priority date? Is the date of Acceptance for processing same as PD? or do I , maybe, have an option to request the filing date as PD. My lawyers have been operating with the April 04 date.
Any advice appreciated.

Second A Numbers for Some Who Filed I-485s During Summer 2007©MurthyDotCom

An applicant who filed her/his employment-based I-485 application between July 2nd and August 17th, who had an A number at the time of filing, was issued a different A number as part of the receipt process. This temporary receipt process allowed the USCIS to issue receipt notices for the high volume of adjustment applications received during the summer of 2007. The USCIS has indicated that it plans to reconcile the second A number for each I-485 applicant with the previously-issued A number. All temporary numbers will also appear on the Employment Authorization Document (EAD).
