Priority dates transfers and Post 140-approval options Discussion related to transferring priority date of old green card file to a new file after 140 approval.

Default I-140 - no communication from USCIS

Folks:

a) My I-140 was applied on Feb 01, 2007 at Nebraska Service Center and no decision has been taken yet.
b) The current processing date as shown on USCIS website is April 06, 2007
c) The last activity on my case number as shown on the USCIS site is Feb 06, 2007.

I spoke to my lawyer about this.
a) He contacted USCIS customer service.
b) They agreed that the I-140 petition is pending beyond normal processing times, and have sent an electronic case status inquiry to Nebraska Service Center.
c) Apparently the Nebraska Service center is expected to respond within 45 days.

Has anybody else faced this? How critical is this? Should I or my employer be contacting USCIS directly?

Default I-140s at NSC

As everything else in USCIS world, processing I-140 applicatons at NSC is also random. I filed my I-140 concurrently with I-485 on July 2nd when the flood gates were opened. The LUD still shows 8/30/07 but my I-140 was approved on 12/17/07. My company lawyers forwarded me copy of approval notice yesterday.

That's interesting. You are the first July 2nd filer that I have heard of who has gotten a 140 approval.

The LUD on mine shows 9/21 (I am a July 2nd filer as well) and no approval yet.

Default No rhyme or reason

There is no order. Its a draw of luck. My I-140 was filed in Feb'07 and was approved in aug '07. This was when their processing time was still Sep '06. I never expected approval and it came thru. But then I got unlucky with 485 NC. Now, even if NC clears I am stuck with retrogression

So, one of these days the ducks will line up for me

I am also in the same boat, mine was filed in dec2006 and LUD was 01/08/2007. I called my lawyer but he doesn't have any answer...

I am waiting for these approval atleast I can go ahead use AC21.

Default Same here

I applied during July and mine was transferred to VSC for receipting. So far no update from USCIS if my case will be processed at VSC or if it will be transferred to TSC or NSC for processing. It frustrating to be in such a position. Also, haven't seen any signs to restart the I-140 premium processing. Can IV push USCIS to restart the I-140 PP at the earliest.
