Priority dates transfers and Post 140-approval options Discussion related to transferring priority date of old green card file to a new file after 140 approval.

Default I-140 approved but the old priority date not assigned

I got my I-140 approval few minutes back but unfortunately US CIS did not assign me the old priority date.

Here are my details:

I had a priority date of October 2005 from my previous job. I changed by jobs and started a new Green Card application. The PERM was filed in June 2007 and at the time of filing the I-140 my attorney requested the service center to assign me the old priority date. I saw the copy of the application and my attorney left no stone unturned to bring the old priority date to the attention of the US CIS.

The US CIS last week issued the approval without any RFE with June 2007 priority date. Any suggestions what can I do?

I am in the same boat. Though, it was my lawyer screw up.
They did't not send PD port request along with I140. They send another letter to uscis to amend I485 to use old pd. Next month my old pd will be current, lawyers are going to send query request to uscis about my application status.
Ask ur lawyer to send amendment to 485 application.

Ask ur lawyer to send amendment to 485 application.
Thanks for the reply. My priority date is not current yet so I cannot file I-485. I would ask them to contact the Customer Service at 1.800 number. Maybe I will ask my employer to contact the US CIS directly.

Where is the PD indicated on the I-140? I am in the same boat. My PD column on the I-140 is blank.

In the blank portion there should have been a date. Are you also trying to recapture another date? What are you/your attorney doing about it?

Yes Kokil, my attorney made the request and I was granted the previous priority date on July 25th. I filed my 485 on August 1st.

My new PERM application was started after I-140 approval - before EAD.

Did your attorney, enclose a seperate letter requesting for PD porting or what steps did you miss that the date was not assigned ??
