Not only for i140, but there are instances where previous W-2's were asked during i-485 interviews . USCIS can always ask for these to compare against H1B LCA's.

We know that form the posts on this forum lot of H1B stamping cases are getting audited and VO is asking for W-2's of all employees work for the employer is a sealed envelope!

Lawyer opened MTTR requesting USCIS to consider First I140 in EB3 category. USCIS accepted it and approved I140 in EB3. Also thankfully USCIS re-instated I485/EAD/AP.

First I-140 Approved on: EB3, 04/09/2008
I485,EAD/AP Re-instated on:04/09/2008

My compnay applied new Labor in EB2 for a different position.

Third Labor Applied on: EB2, 11/2010
Third Labor Approved on: EB2, 12/08/2010

When applying I-140, my comapny lawyer requested USCIS to port 04/21/2003 PD for this new I-140 application.
Third I-140 Applied on: EB2, 1/26/2011

USCIS approved I-140 in EB2 and also ported the PD to 04/21/2003 in the I140 approval notice.
Third I-140 Approved on: EB2, 2/7/2011


Now that my PD is current, all I got to do is to wait for my I-485 approval decision.

Do we need to file again for 485 to port the older priority date? I know that new I-140 will have the older priority date. Does that automatically trigger the review of our existing 485? or do we need to apply again with reference of EB2?
Do we get any receipt notice?
I am in the same boat of porting of my EB3/2003 priority date. got the new EB2 I 140 approved last month with priority date ported successfully.

Hi,

I just spoke with my employer. Looks like lawyer needs to write (inter-filing) a letter to USCIS requesting adjudicating my 485.

I was under impression that once old PD appears on new I140, it automatically triggers 485 inter-filing. Which apparently is not the case. Lawyer have to write letter to USCIS requesting inter-filing.

Don't you need to do inter-filing to get 485 approved? Can you please explain what will be the next steps now that your EB2 I-140 has been approved with your EB3 priority date - this means that you are current under the new visa bulletin now right?

You are right. Looks like we need to write letter to USCIS requesting inter-filing to adjudicate 485. My lawyer is writing this letter now. I was under false impression that once PD is current it automatically qualifies for 485 adjudicating when we port from EB3 to EB2.

During my time of GC journey, I did the same thing of porting from EB3 to EB2 successfully with the same company for different position in the same IT field. Despite being inter-filed by attorney, it took some time for USCIS to update by 485 (6 months) to EB2 category before it is being approved. After a while, take an Infopass and check whether your 485 is moved from EB3 to EB2.

Default Question on EB3-EB2 porting

Friends;
My EB3-I PD is Aug, 2004 and I got filed for my AOS in July, 2007 along with my wife and daughter.
If my PD is ported to EB2 with same employer, what happens to my family member's AOS, are they ported too or not?
They are not dependant on me any more as they both have EADs and my daughter is in undergrad college.
