Default Eb3-Eb2 porting 140 approved same employer

With all the discussion about the risks about porting I thought I will give people some new news so that they can decide better.

1. My Eb2 I-140 was approved on Friday in Premium processing (took exactly 3 weeks, not a day less).
2. I am with same employer and used my in-company experience for the porting.
3. Labor was approved in 14 days also.
4. No questions were asked about Eb3 position or the job as some people have mentioned.

Good luck to all who are planning to do the same, believe me it is worth the risk. Looking at the Bulletin and getting disappointed is no fun especially if you are stuck in the process for 10 years.


Few things:
My employer is a Fortune 10 company
I moved from Technology(original Eb3) to Finance (Eb2).

It makes the difference....no wonder there is no questions asked. As I always said, if the EB2 job is genuine, there wont be any issues. The problem might come only for people with consulting companies.

Congrats and we are happy for you. As long as job is genuine, one should not have any problem. I am sure your company must have done enough legwork before filing your case.

If no questions were asked about EB3 for you, it doesnt mean it wont be asked for others. Everyone should be informed about each scenario and be ready to tale what will come. As always said when a company do one in thousand cases it looks genuine. But once your employer will start doing this for number of employees it is a red flag. USCIS has record of going back and revoking/reconsidering approved I-140s.

In my personal opinion what would happen to future EB3 job is a genuine question to consider. Outcomes may differ on case to case basis depending upon case in hand and discretion of USCIS official.

Can you please tell me how you did this. When did the preparation start, and also any issues RFEs. Is it an American company or a desi. Anything you see different than most typical companies, Please let me know

Read the post again. Its a Fortune 10 company and he was moved to different position. Its not a tailor made position and he is not working for desi consultant

Default EB3 to EB2 Poritng successful with same employer

Hi,

Just want to share my GC saga .. I was able successfully port EB3 PD to EB2 last week.

I work for a consulting company and was working with this company sine 2003 and was able to successfully port my EB3 PD to EB2.

First Labor Applied on: EB3, 04/21/2003 from NJ state.

Since NJ Labor processing times were painfully slow movement, my company decided to apply new EB3 labor from RI state.

Second Labor Applied on: EB3, 12/02/2004

Both the above labors are STUCK big time in Phidelelphia Backlog Elimination Center for a very long time (about 4 years).

Second Labor Approved on: 06/12/2007

First Labor Approved on: 07/18/2007

First I-140 Applied on: 06/25/2007
I485,EAD/AP Applied on: 8/01/2007

Second I-140 Applied on:12/11/2007
Second I-140 Approved on:04/16/2008

First I-140 Denied on: EB3, 03/09/2008 (Reason for denial: Lawyer mistakenly applied I 140 in EB2. I still beleive its a honest mistake from his side becuase of July 2007 rush.)

I485,EAD/AP Denied on:03/09/2008

Lawyer opened MTTR requesting USCIS to consider First I140 in EB3 category. USCIS accepted it and approved I140 in EB3. Also thankfully USCIS re-instated I485/EAD/AP.

First I-140 Approved on: EB3, 04/09/2008
I485,EAD/AP Re-instated on:04/09/2008

My compnay applied new Labor in EB2 for a different position.

Third Labor Applied on: EB2, 11/2010
Third Labor Approved on: EB2, 12/08/2010

When applying I-140, my comapny lawyer requested USCIS to port 04/21/2003 PD for this new I-140 application.
Third I-140 Applied on: EB2, 1/26/2011

USCIS approved I-140 in EB2 and also ported the PD to 04/21/2003 in the I140 approval notice.
Third I-140 Approved on: EB2, 2/7/2011


Now that my PD is current, all I got to do is to wait for my I-485 approval decision.

Congartulation abhishek101

As some one said these succesfull porting are on case to case basis so anyone trying to port should review their situation and talk to company and lawyers and estimate their chances of succesfull porting before they start the process

On a side note THANK YOU abhishek101. Now there is one less person in front of me in the EB3 line

How much experience did you have before joining the current employer in 2003?

I mean for your EB2 advertisement (application) the criteria used was B.Tech + how many years of experience?

Don't you need to do inter-filing to get 485 approved? Can you please explain what will be the next steps now that your EB2 I-140 has been approved with your EB3 priority date - this means that you are current under the new visa bulletin now right?
