The I-485 beneficiary is considered (charged) from the country where the beneficiary was born, regardless of current citizenship. For example, a person born in India immigrated to Canada, but they will still be charged to India.

The following exception applies to this rule:

  • Cross Chargeability - Beneficiary can use their spouse's country of changeability as long as I-485 for both are being applied at the same time.
