As you may know, the comments period for the Spousal Work Authorization Administrative fix is over. Immigration Voice strongly supports this fix and we applaud DHS for the proposed regulation.
On behalf of the organization we submitted our comments and recommendations to further improve the proposed regulation for allowing EAD for certain H4 visa holders.
Here is the summary of our recommendations as improvement over the proposed regulation:
- Federal agencies (USDOL and USCIS) to provide the immigration case related paperwork upon request from the beneficiary so H-4 dependents could provide proof to get benefit of this fix
- Allow eligible children of legal skilled immigrants to obtain work authorization, just as spouses on H-4. This could help prevent kids from “aging-out” upon reaching 21 years of age.
- USCIS should consider granting automatic extensions of work authorization to prevent unnecessary stress when working on EAD card USCIS should consider allowing submitting and receiving of adjustment of status when a visa number is not available (meaning when dates are not current), allowing backlogged applicants can get work authorization and advance parole.
